Reps Introduce Bipartisan Bill To Legalize Mobile Device Unlocking

A bill would 'make it permanently legal for consumers to unlock their mobile devices, and consumers would not be required to obtain permission from their carrier before switching to a new carrier.' 'This bill reflects the way we use this technology in our everyday lives,' Rep. Lofgren said. 'Americans should not be subject to fines and criminal liability for merely unlocking devices and media they legally purchased. If consumers are not violating copyright or some other law, there's little reason to hold back the benefits of unlocking so people can continue using their devices.' Now, what chance does this have of actually passing?"

Landlords beware: Airbnb is booming in big cities, but many users run legal risks

Nigel Warren can get $105 a night for renting out his room in an East Village apartment on the vacation rentals site Airbnb, which is what he did for three nights during a trip to Colorado in September. When he returned, his landlord informed him that the building had been raided by officials from the Mayor’s Office of Special Enforcement, who alleged that the arrangement violated New York state’s illegal hotels law.

As a consequence, Warren is now facing $7,000 in fines from the City of New York. Warren had only rented his apartment twice in the two years before he got caught. "The amount of fines seems exorbitant based on what I did," he told a judge today.

On Thursday, Warren showed up at the New York City Environmental Control Board (ECB) in the Financial District for his fourth or fifth hearing on the matter (he couldn’t remember which). In the room were three representatives from Airbnb, including a lawyer from the prestigious firm Gibson Dunn, which filed a brief on Warren’s behalf.

It’s the first time Airbnb, a Silicon Valley darling with a multi-billion dollar valuation, has intervened in such a case. The company makes it easy for anyone to convert property into an amateur hotel — a little too easy, officials in some cities say. Safety and fire code standards tend to be stricter for hotels than for residential dwellings, and hotels are often subject to extra taxes. Furthermore, the issue affects a ton of groups, including landlords, neighbors, tenant associations, and housing associations.

New York City has become the focus of Airbnb’s national fight against regulators. "What we’d like to do is figure out a way to make New York the model city," David Hantman, Airbnb’s public policy chief, told Skift in January.

Airbnb took 300,000 bookings in New York City last year and is growing fast. The company is on track to do $1 billion in bookings in the city this year, startup investor Fred Wilson told The Verge.

But based on amendments to a state law passed in 2011, at least half of the listings on the site are illegal.

The New York law was amended in order to crack down on illegal hotels being run by companies such as Smart Apartments, which bought residential apartments and rented them out for short-term stays. The law seems to allow people to rent rooms under certain conditions, but forbids people from renting their entire apartments. The second category accounts for about half the listings based on sample searches conducted by The Verge.

The law apparently includes an exception for short-term rentals if the tenant is home, which would cover all the private and shared rooms that make up the rest of Airbnb’s inventory. That’s the exception that Warren argued, since his roommate was home while he was renting his room.

That interpretation goes against the spirit of the law, said Michael Burns, who argued on behalf of the Department of Buildings. "You don’t know these people? They’re not your friends?" he asked Warren, who affirmed. "They should stay in a hotel," Burns said.

If the ECB rules against Warren, it could mean the city considers all the listings on Airbnb illegal.

State senator Liz Krueger, who co-sponsored the recent legislation, believes there is a discrepancy between what Airbnb advertises and how it’s being used.

"A quick glance at Airbnb's New York listings will show a ton of listings for the same or similar apartments, listed by the same users," she said in an email statement. "Airbnb is acting as middleman for large illegal businesses like Toshi and Smart Apartments, which are illegally converting residential apartments for full-time use by visitors to New York."

Airbnb says 87 percent of its New York City hosts have only one listing, which acknowledges that 13 percent come from hosts with multiple listings but contradicts the idea that the site is overrun by massive illegal hoteliers. Smart Apartments has definitely advertised on Airbnb before; the company has had a profile since November 2011.

The existence of large-scale listings doesn’t mean they’re being booked, however. While listings from bigger companies such as Smart Apartments frequently pop up on Craigslist, The Verge was unable to find listings on Airbnb that obviously belonged to a large-scale operation.

Warren’s case is bad press for Airbnb, which doesn’t make much of an effort to alert its users to the fact that they may be breaking the law. However, the company plans to push for an amendment or a new law that will unambiguously sanction Airbnb’s peer-to-peer model.

A judge will decide within a month whether to uphold the fines. In the meantime, he suggests New Yorkers avoid hosting on Airbnb.

Fungus network lets plants alert each other to defend themselves against aphid attacks

Underground fungus and plants have long been known to have a mutually beneficial relationship — mycorrhizal fungi delivers nutrients to plants, and the plants give carbon back in exchange. Now, a new study published in Ecology Letters shows in addition to that tradeoff, the mycorrhizal fungus network that connects many plants actually lets those plants defend themselves against enemies like aphids. As reported by the BBC, the study focused on the chemical response many plants emit when under attack from aphids, which commonly feed on damaged plants — the response typically repels the attacks and also the aphid's natural predator. As part of the test, the researchers grew five broad bean plans — three that were connected through the mycorrhizal fungi network, and two that didn't have that network in place, and all of the plans were covered with bags to prevent chemical communication through the air.

The researchers then let a single plant be attacked with aphids, and discovered that un-infested plants began to mount the same chemical defenses, thanks to communication through the fungi network. Plants that weren't connected to the fungi, however, did not mount their defenses. Of course, the fungi have a stake in keeping the plants alive — if the plants die off from aphid attacks, the fungi won't receive its carbon transmission. Professor John Pickett of Rothamsted Research called the fungi / plant relationship "just such a fantastic signalling system." The researchers believe that this finding could help plants defend against aphid attacks by using a "sacrificial" plant that can warn the rest of the crops.

As the US continues to grapple with the idea of letting drones fly through the country's airspace, our neighbors to the north have reported a new milestone for unmanned aerial technology: the first life saved using a drone. The Royal Canadian Mounted Police in the province of Saskatchewan announced yesterday that they successfully used the small Draganflyer X4-ES helicopter drone to locate and treat an injured man whose car had flipped over in a remote, wooded area in near-freezing temperatures. Zenon Dragan, president and founder of the Draganfly company that makes the drone, said in a statement: "to our knowledge, this is the first time that a life may have been saved with the use of a sUAS (small Unmanned Aerial System) helicopter."

The injured driver, whose name has not been released, managed to call 911 from his mobile phone, but he didn't know his location and couldn't guide emergency responders to him. Police deployed a regular, manned helicopter equipped with night vision to try and find him, but they weren't able to in an initial sweep of the area. After several hours without any sign of the accident victim, they decided to try a Draganflyer drone with an infrared camera, flying it toward the last recorded location from his cell phone's GPS. The drone's infrared camera picked up three heat signatures, one of which turned out to be the man, who was "curled up in a ball at the base of a tree next to snow bank" and unresponsive, as the RCMP recounts in its official news release. Emergency responders took him to a hospital for treatment. " Without the UAV [unmanned aerial vehicle] and FLIR [infrared camera], searchers would not have been able to locate the driver until daylight," the RCMP news release adds.

While a handful of other police agencies in Canada and the US have previously admitted to using drones in search-and-rescue operations, there haven't been any reports of these operations finding an injured person in time to get them medical attention. The first "drone arrest" was claimed by police in the UK in 2010.

When you mention web-spinning games, there’s one distinct cry: Spider-Man 2! Lauded for its swooshing through the streets, it’s the game to which all others fall short in this respect. As we reported a few months back, the man responsible for that well-loved slinging is working on Energy Hook, that intends to take the mechanic and go further with it. That’s Jamie Fristrom, the technical director and designer on Spidey 2, who was the one who ensured that the webs had to attach to buildings, rather than the sky. And now he’s after you cash. All $1 of it.

Energy Hook appears to be a combination of accurate rope swinging, and stunt games like SSX. Fristrom’s odd Kickstarter goal of a single dollar is, he says, because he’s determined that he’s going to finish this game no matter how much is raised. But the more he gets, the better that game he can make will be. He has, in essence, gamed Kickstarter to be purely about pre-ordering and stretch goals.

Were you a cynical type, you could also argue he’s gaming Kickstarter to get around the need to clear a particular funding goal before he gets the cash – but then since so many projects deliberately set their figures lower than they need, and rely on stretch goals, if anything it seems a more honest approach. His stretch goals go up to $130,000 presently, with a new set of levels added at $90k, but the assurance is that the game will be finished and released if just a buck is raised. It’ll be interesting to see how donators react to the approach. It’ll be $10 to secure a copy of the game on release.

This is a fascinating concept. We’re not sure of its usefulness, but it definitely stands on its own just for the concept. [Dean Camera] just added a new HID class to the LUFA project that lets you flash AVR chips by printing to them. This means once you have a file like the one seen open in Notepad above, you can just click on File, then on Print, and the firmware will be uploaded to the chip.

[Dean] is the creator of the LUFA project and still likes to get his hands dirty hacking around with it. This idea came to him while he was exploring the concept of using the MIDI protocol to program a chip. That didn’t pan out because of the way Microsoft has handled MIDI in newer versions of Windows. But he did get the idea of making LUFA identify itself as a simple USB printer. He dug into the specification and figured out how to do that. Once Windows connects to the device it doesn’t really care what data gets sent to it. So [Dean] wrote a parser for the bootloader which could accept the incoming hex code and write it to the chip’s program memory.

Google CEO Larry Page has reportedly canceled plans to launch the long rumored Wallet credit card ahead of the company's annual I/O developer event commencing next week. According to AllThingsD, Google will roll out updates to its Wallet service at the event — which include new rewards, offers, and loyalty points — but will not launch the credit card, after it performed badly in tests overseen by Google's chief executive.

The company has been linked with the launch of a credit card since November, when a leaked version of the Wallet app revealed references to a physical card that would mimic a user's existing credit or debit cards. Google later provided more evidence that a Wallet card was coming, publishing details on a support page that stated the card would be compatible with any Android device running 2.3.3 or above.

Earlier this week, the company confirmed that vice president of Google Wallet, Osama Bedier, was leaving the company. AllThingsD's sources say Page had previously questioned the launch of a physical card, believing that the solution did not offer innovative features capable of rivalling payment startups like Square.

Something shady is going on in the province of Ontario with Silicon Knights and the full story is still shaking out. Yesterday it was reported that Precursor Games, which is working on the curiously funded Shadow of the Eternals - a "spiritual successor" to Silicon Knights' Eternal Darkness: Sanity's Requiem - bought and implemented Silicon Knights' assets into their new project.

Polygon also reported late yesterday that Silicon Knights' offices are now empty (stopping just short of closing), and that despite there being "no connection to Silicon Knights" according to Precursor Games' CEO Paul Caporicci, former SK head Dennis Dyack confirmed that he had left SK and was now chief creative officer at Precursor. Polygon has way, way more on this.

Silicon Knights lost a multi-million, multi-year lawsuit against Epic Games last year and there's still questions about the money the company may or may not have gotten from the Ontario government. More on this is sure to be revealed in its time.

The Legend of Zelda, starring Princess Zelda

Shin Zelda Densetsu is an old homebrew project, released back in 2004 by Aesirraven and Lord Steak, but the ROM hack suffered a game-breaking bug in one of its dungeons. Chris Miller has just released a patch that should finally fix the issue and allow people to complete the game now!

It’s a complete overhaul of the original Zelda game, and from what I hear it’s quite good. Miller summarizes the changes:

“In a novel twist, the player must guide Princess Zelda on a quest to rescue Link from the forces of evil. The overworld is completely revamped, with few if any recognizable landmarks or routes from the original game. It is superbly designed, and won’t bore the player. The same goes for the dungeons. Instead of numbered levels, the dungeons are identified by symbols of the zodiac.”

I love that the list of classic games hacked to offer playable female protagonists is growing.

Brian is a 16-year-old caucasian teenager that lives in Oklahoma. He is mad about basketball. In his freshman year of high school, he tried out for the basketball team and is now the assistant of the team. He has always aspired to play like his hero Kevin Durant. When practicing basketball on his driveway, his sister comes out to film him. He ends up hurting himself and the sister later gave the video to Connor, the star player of the basketball team. When he got to school he saw a new girl Isabella who he immediately likes. Connor shows the tape of Brian practicing to the whole school during lunchtime and when his father comes home, hearing that he has has a rough day, decided to take him to a Thunder game. The Thunder are playing the Detroit Pistons at Chesapeake Energy Arena in Oklahoma City. At halftime Brian is chosen to shoot a half-court shot which he misses and hits the mascot in the process. Later on, he gets a chance to meet Durant and expresses his desire to play just like him. Durant signs the special edition Oklahoma City Thunder basketball that Brian got to shoot the half-court shot with. Brian says “I wish I had your talent” and Durant replies “I wish I could give it to you man, but listen, hard work beats talent when talent fails to work hard,” then there is a surge of energy that goes through the ball. In the morning you hear on the radio that the Thunder lost and Durant shot 0-17 from the field in the 2nd half. In the morning he learns that Connor, who was at the game recorded him missing the half-court shot and posted it online. Later that night he goes out to a carnival and after Connor fails to hit shots to win a prize for the new girl, Isabella. He laughs and Connor gives him the ball, saying “You try and do better”. Brian then makes the shot and wins a prize which he gives it to Isabella. Durant then goes to practice the next morning and his agent thinks he is unhappy about something but he simply say he is in a slump. When Brian goes out to shoot the next morning he is making shots unlike he usually does and even discovers he can dunk. Brian then goes to re try out for the basketball team and after seeing him play they let him on the team. He then films himself and dunking over the hood of a car. Durant’s agent meets with a female basketball player comes to meet with Durant’s agent and is angry because she was branded as the female Kevin Durant however this marketing campaign is no longer good now that Durant is in a slump. In Brian’s first game Connor refuses to pass him the ball until he is told to by his coach and Brian immediately becomes a star. The NBA on TNT crew then talks about Durant and Charles Barkley says “Durant is playing like a Mechanic”. When Durant goes to practice his mum comes and dresses like a cheerleader to cheer him on. Brian meets the new girl Isabella at the Go-Kart track and races her. Durant then goes to film a commercial about his new shoes - the KD IV - and cannot film it as he can no longer do the necessary skills. Kevin Durant’s agent discovers Brian and realizes what has happened. He meets Brian in a parking lot on a date with Isabella but he is told to go away as he wants to hang out with Isabella. He gets Durant to come to Brian’s school hoping to stop the switch and it does not work. He then confronts Brian about it at a party and Brian does not believe him. At a pep rally Isabella says that she cannot go out with him as he is too focused on basketball. Brian then sees a poster of Kevin Durant and decided to try and switch it back. It does not work and Durant decided that he would have to start over. After having to show Isabella and realizes that he has to hit the mascot with the ball first. Then when he goes to the ground he hits the mascot and they repeat the original encounter except opposite and Kevin Durant gets his talent back. Durant gets back to full form and the Thunder qualify for the playoffs. Then at the game to make the playoffs for the Eagles (Brian’s team) although he does not have the talent he still manages to lead his team to a close game and make the final shot to put them up by 1, this means that they make the state playoffs for the first time in 32 years. Then you see Brian practicing with Kevin Durant and you can see him getting better before the movie cuts to credits.

can we just talk about this for a minute

because seriously i have so much respect for the adventure time team. they’ve made a successful cartoon that isn’t random poop and fart jokes for a solid eleven minutes. sure, adventure time has its immature moments, but then there’s parts like this.

pb’s backed up against the wall in a position that’s way too common in today’s society. you can tell she’s scared and uncomfortable. so what does she do? she beats the shit out of ricardio.

she doesn’t “play nice”, she doesn’t “let him down gently”, she tears off his limbs and stomps on his face. then ricardio tries to play the nice guy card and she has none of it. it’s refreshing to see something aimed at children that doesn’t state that girls need to be polite and sweet and stand by while someone makes them uncomfortable.

basically, i love this show and i love how it teaches girls something that’ll actually come in handy some day. god fucking bless.

It would be nice if what your reader said was true: that the nearly 40 percent increase in rape occurred because victims now feel more comfortable reporting it. (I said “victims” and not “women” because more than half of rapes in the military are done to men.) The nearly 40 percent jump was for cases of sexual assault reported in an anonymous survey. The number of reported rapes has stayed about the same. This shows the opposite of what the reader said – that no progress is being made in making victims feel that reporting their rape will lead to anything positive.

The most surprising thing about the public discussion of military sexual assault is that no one has said “duh.” Think about it – the military:

Is composed largely of men in their sexual prime;
who are in peak physical condition;
who are trained to be aggressive and violent;
who are deprived of the opportunity for normal sexual relationships for months at a time;
who are subjected to enormous stress and fear of death.

Take a lot of guys in their horniest ages, whip their bodies into prime shape, teach them aggression and violence, show them they might not live much longer, and deprive them of most opportunities for sex. What the hell do we think is going to happen?

This is not to excuse sexual assault at all. It is, rather, to indict the military establishment’s unpreparedness or unwillingness to deal with it. They should have seen it coming a mile away.

Methuen teen held as a dangerous person

LAWRENCE — An 18-year-old Methuen High School student charged with making online threats that included outdoing the Boston Marathon bombers has been ordered held without bail for 90 days.

A judge in Lawrence District Court ruled Thursday that Cameron D'Ambrosio posed a threat to the community, not only for the Facebook comments he allegedly made last month, but for a pattern of threatening violence, including a recent threat to stab his sister.

D'Ambrosio has been held in jail since his arrest May 1 on a charge of communicating a terrorist threat.
