FISA court judge: No company has ever challenged Patriot Act sharing

According to one of the 11 judges that sits on the Foreign Intelligence Surveillance Court (FISC), no corporation ever served with a “business record” court order under the Patriot Act has ever challenged one, even though the law provides them a means to do so.

In other words, when the government asked Verizon to hand over call records and other metadata to the National Security Agency (NSA), the company did so without so much as a peep. Earlier this month, the Electronic Privacy Information Center filed an emergency petition to the Supreme Court to halt the entire metadata sharing program.

In a new 11-page letter published Monday from FISC Presiding Judge Reggie B. Walton to Sen. Patrick Leahy (D-VT), the judge writes, “To date no recipient of a production order has opted to invoke this section of the statute.” (Leahy is set to hold a senatorial hearing on the government surveillance program this week.)

MIT defends itself in a new report on Aaron Swartz’s suicide

“MIT did not request that federal charges be brought against Aaron Swartz. It was not consulted about its opinion about appropriate charges or punishment, and it did not offer any,” writes MIT in its report.

MIT has released a report on its involvement in the controversial prosecution and subsequent suicide of Aaron Swartz, who at the time of his death was facing 13 federal felony charges for downloading academic papers via MIT’s network.

At issue is whether or not MIT contributed to what many describe as the unjust prosecution of Swartz, co-founder of Reddit and a prominent advocate for open access to information online, by federal authorities. MIT’s report asserts that the university remained “neutral” throughout the prosecution of Swartz, after considering conflicting opinions of faculty members about whether MIT should ask federal prosecutors to cease pressing the case against Swartz.

From MIT’s report:

The Institute made no public statements regarding the merits of the case against Swartz or whether it should proceed, nor did it attempt to influence the prosecutor’s decisions on the case, other than to tell the prosecutor that the government should not proceed on the assumption that MIT wanted Aaron Swartz to go to jail.

Defenders of Swartz have already responded to MIT’s report, starting with the late Swartz’s partner, Taren Stinebrickner-Kauffman, who writes on her blog that the new report is a “whitewash.” Stinebrickner-Kauffman goes on to accuse MIT of giving the prosecution in the case “total access to witnesses and evidence, while refusing access to Aaron’s lawyers to the exact same witnesses and evidence.”

In its report, MIT notes that while it had the opportunity to ask authorities not to go forward with prosecution of Swartz, and Swartz’s father as well as two faculty members urged the institution to do so, other faculty expressed opposing views. I have heard from many in our community who believe our actions were proper and justified,” wrote MIT president Rafael Reif in a letter issued to the MIT community. “Others feel differently, and the review panel identifies alternate paths we could have followed, including becoming more actively involved in the case as it evolved.”

Lawrence Lessig, an academic who has commented frequently on the Swartz case and is best known for his advocacy of looser laws governing copyright, contends on his blog that the report indicates that the government may not have even had a case against Swartz in the first place, because of the subtleties of whether or not Swartz’s access to MIT’s networks was in fact unauthorized. “If indeed Aaron’s access was not “unauthorized” — as Aaron’s team said from the start, and now MIT seems to acknowledge — then the tragedy of this prosecution has only increased,” writes Lessig.

At the end of MIT’s report, the university sums up its findings. The fourth finding listed suggests that the university had no idea this case would be as big or as controversial as it has become—leading, for example, to the proposed reform of a US federal law that would have made it difficult to prosecute Swartz for the crimes he allegedly committed.

At least one service, however, did not welcome the change, and is now planning to close up shop next month: The Old Reader. In fact, if you navigate to the service's homepage now, you'll be greeted by this sad message: "Unfortunately we had to disable user registration at The Old Reader." In two weeks, the public site will be shut down and a private one, available to a select few (accounts will be migrated automatically), will take its place." An update on the story says "We have received a number of proposals that we are discussing right now. Chances are high that public The Old Reader will live after all," so a reprieve may be possible.

A Good Samaritan snapped photos of what appeared to be two men impersonating police officers involved in a pistol-whipping and robbery outside a Citgo gas station on Detroit's east side on July 21. Once Fox 2 aired those photos, an even more disturbing picture developed. ... Now under arrest are two police sergeants, a 47-year-old officer and 20-year veteran.

Don't worry, everything will be ok, they have a Robocop statue.

When he did so, doctors realized that he carries a rare immune globulin that can prevent unborn babies from suffering attacks by their mothers’ antibodies, a condition known as Rhesus disease.

In the 59 years since this was discovered, Harrison has given blood more than 1,000 times, an average of once every three weeks for five decades, and his donations have saved an estimated 2.4 million babies.

This has earned Harrison a spot in Guinness World Records. He calls this “the only record that I hope is broken.”

While Vine, Flipboard, and Path have all promised Windows Phone 8 support, one particular app is still missing: Instagram. Nokia has tried to pressure Facebook into building an Instagram Windows Phone app, but so far users have had to resort to third-party applications. Instance, a popular unofficial Windows Phone Instagram app that supports viewing and uploading of Instagram photos, appears to now be blocked from using the photo sharing service.


Daniel Gary, the developer behind Instance claims that Instagram is deleting images after they're uploaded to the service using the third-party Instance Windows Phone app. During our own tests we've been able to confirm that photos do indeed upload to Instagram from the Instance application, and are visible on Instagram's website if you're logged in using your own profile. After just seconds, the photos disappear from an Instagram account and the URLs to access them no longer work. On one Verge staff account, a photo uploaded last week using Instance is no longer visible publicly for others to see, but is still stored under the account.

It appears that Facebook is tracking uploads from the Instance app, and perhaps other unofficial Instagram apps, and is actively deleting user content. Gary was previously forced to change the name of his application from "Itsdagram" to Instance, and we've reached to him for comment on the removals. We've also contacted Facebook to comment on the content removals, and we'll update you accordingly.

SkyDrive updated with animated GIF, high DPI, and new sharing support

Microsoft is rolling out a number of changes to its SkyDrive cloud-based storage service this week. While the service has long supported high resolution imagery, including RAW files, SkyDrive will now measure the DPI scale of a device and display a higher resolution photo and thumbnail. Not all browsers support high DPI yet, but the subtle change should improve the viewing experience over time.

Alongside the DPI improvements, Microsoft is finally supporting animated GIFs in SkyDrive. While you've been able to store the GIF format on SkyDrive, it was never animated when shared via the service. That's now been rectified, and Microsoft is also improving the way users share documents and folders from the service. You can now select multiple photos or files and share them in batches, rather than having to share them individually or through an entire folder. An updated shared view also makes it easier to see what files you've previously shared and to whom.

Developers get code file support

Other improvements include the ability to rotate photos in the viewer, and the ability to filter folders from the all photos view. SkyDrive users will also be able to share documents or photos without recipients having to sign in to edit them. It's a similar change to Microsoft's recent Office Web Apps update. Finally, for developers and power users SkyDrive now supports JavaScript, CSS, HTML, and other code files to edit them online. Syntax highlighting, find, and word competition is all supported too.

'Bioshock Infinite' DLC will take you back to Rapture, let you play as Elizabeth

If Bioshock Infinite's ending left you wanting a little more Rapture in your gameplay, 2K and Irrational Games are set to deliver on that wish. Following the news that the first Bioshock Infinite downloadable content is now available comes the surprise announcement of a new two-part campaign that will put you back in a bathysphere and see you return to Andrew Ryan's underwater city. The first instalment will see you take on the role of private investigator Booker DeWitt, but in the second, you'll play as Elizabeth.


"It's a love letter to the fans."

The two-pack installment, named Burial at Sea, takes Booker and Elizabeth back to Rapture before its art deco architecture has turned to ruin and the Little Sisters have been corrupted. Irrational Games co-founder Ken Levine calls the two-part DLC "a love letter to the fans," telling Polygon that the team has been working on Burial at Sea since they shipped Infinite. "We really listened to the fans and we know how they feel about Elizabeth," Levine said. "We decided we wanted to shift things around a little bit for the third one, so the player character in the third DLC, you get to play Elizabeth and the gameplay is quite different as her."

Levine also promised that Burial at Sea will also feature many of the same faces from the first two Bioshock titles, helping to explain Infinite's twisty finale. Clash in the Clouds, the new challenging and combat-focused DLC pack is available today for $5 on Steam and Xbox 360, while the two-part Burial At Sea campaign — which does not yet have a release date — will cost $15 individually. Alternatively, you can get all three installments for $19.99 with a Season Pass.

The disunited state of Android

There can be few charts that better demonstrate how Samsung has come to completely dominate the Android smartphone market: saturation. According to OS's data, Samsung now has a 47.5 percent share of the market, distributed across more than one hundred different models. Of course, flagship devices like the Galaxy S 4, Galaxy S III, and Galaxy Note II are among the best sellers, but there are also some other, less high-end handsets that feature prominently as well. The Galaxy Y, a super low-cost handset from 2011, is still the third-most used phone in the world. The only non-Samsung device in the top 10 is the LG Nexus 4, while the Asus-made Nexus 7 just squeezes in the top 15, and the first Sony device is placed at 21. HTC's only entrant in the top 30 is the One, its well-received flagship.

This mix of old and new hardware in the device chart, as well as lax update policies from manufacturers, leads us to an inevitable point: Android fragmentation. It's been the butt of many an Apple keynote joke, and is frequently cited as a major problem for Google, but is it getting better or worse? According to OS, its worse now than ever before. The company used Google's data for the visualization above, which groups Android by the API set that each version uses. With the release of Android 4.3, we're now up to level 18 of the Android API, but OS's charts don't reflect the recent change. The most prevalent version of Android remains Gingerbread, released in 2011, and stuck on API level 10. Next is Android 4.1 Jellybean, followed by 4.0 Ice Cream Sandwich. The white line in the middle of OS's chart shows the marketshare of the leading API level (in this case level 10) is lower than ever, but, in the long run, the rise of a more modern API level will undoubtably be a good thing for Android.

Screensize

Our final chart shows the massive variation in Android screen sizes. Android is designed to work across a huge array of product types, from smartphones, tablets, and all-in-ones to devices you wouldn't expect, like fridges and ovens. Google has put a lot of effort into designing tools that allow developers to scale their apps across multiple devices, and, after seeing the massive variation in screen sizes, it's clear for everyone to see why. OS has several more visualizations — and the above chart in interactive form — available on its website.
