Elizabeth Warren, Elijah Cummings expose lies of investment advisors

If a woman could marry an intangible concept, I would totally dump the boyfriend and marry Senator Warren's sass.

Remember a few weeks ago when AIG said it had to sell off its broker-dealer network because of a new rule the administration is implementing? That rule requires advisors to tell their clients seeking retirement advice when they have a conflict of interest, and says that brokers should be advising clients based on what's best for the client. Which is the worst thing in the world, says pretty much the whole investment advisor community and what they've been telling the Department of Labor in the comment period about the new rule. 

But guess what? They're lying about that, and Sen. Elizabeth Warren has got the goods to prove that lie.

[B]ehind the scenes, in earnings calls with their own shareholders, these same companies are downplaying the impact of the rule, reassuring that they could easily handle the changes.

This contradiction was revealed in a letter from Senator Elizabeth Warren and Congressman Elijah Cummings made public Thursday. The letter highlights four companies with investment advisory units, contrasting their public and private statements, and implicitly raising the question: Are they lying to the Department of Labor, or to their shareholders?

For example, in a letter to the Labor Department last July, Jackson National Life Insurance Company president James Sopha called the proposal "bad for investors and for America," and said that "it will be very difficult, if not impossible for financial professionals and firms to comply with the requirements."

But in a call with shareholders, the CEO of Jackson's parent company, Prudential U.K., said that the company would "build whatever product is appropriate… and adapt faster and more effectively than competitors."

Warren and Cummings provided this example, and many more, to the Department of Labor and to the Office of Management and Budget, which is providing the final review for the new rule. "Publicly traded companies are rarely held accountable for the assertions they make when lobbying in Washington," the two write. "But when communicating with investors, publicly traded companies are required by law to provide full and accurate information about any material matter that may affect their business models or stock valuations." Thus, they conclude, the information these companies are providing to investors "must represent their true and accurate assessments of the impact of the proposed rule or they would be in violation of federal securities law."

In other words, believe what they're telling investors—these new rules are no big thing—instead of the sky-will-fall-in-on-us threats they're making to the regulators.

Instead, Obama’s conversation with Ellen DeGeneres was mostly a heartfelt reflection on his presidency. And he surprised the host by giving her credit for what has been perhaps the biggest social sea change of the last eight years.

“I cannot thank you enough for what you have done for the gay community,” DeGeneres told the president to cheers from her studio audience.

Calling nationwide marriage equality and the end of “Don’t Ask, Don’t Tell” some of his “proudest” achievements, Obama quickly turned the praise around on DeGeneres. As much as he has been able to do with laws, he said, “Changing hearts and minds, I don’t think anyone has been as influential as you on that. I really mean it. That’s true.”

“Your courage — and you’re just really likable,” Obama continued as DeGeneres visibly took a deep breath to compose herself. “You being willing to claim who you were, that suddenly empowers other people and then suddenly it’s your brother, it’s your uncle, it’s your best friend, it’s your co-workers and then attitudes shift. And the laws followed, but it started with folks like you. I’m so proud of you.”

Acknowledging that we live in a racist society is not an attack on any given individual, it is simply a reminder that we have a lot of work to do.

A Virginia school district has abandoned its usage of a short video on race and affirmative action for a high school Black History Month event after parents and students complained about its content. The AP reports:

A school district in Virginia has decided not to use a video about race and affirmative action after it made students uncomfortable and drew criticism from parents who called it "white guilt."

The video was shown at Glen Allen High School during two assemblies for Black History Month. It depicts several runners on a track, with black runners facing insurmountable obstacles while white runners are unimpeded.

The four-minute video is titled "Structural Discrimination: The Unequal Opportunity Race." It was created for the African American Policy Forum.

Henrico County School Board Chairwoman Michelle Ogburn apologized to those who were offended and said administrators across the district have been instructed not to use the video. She says steps are being taken to prevent the use of racially divisive materials in the future.

I’m reading Don Quixote for my world literature class and apparently when it was first published in 1605 it was world-changingly popular, one of the first “popular novels” as we know it today, and there were all sorts of people who were writing and publishing their own unofficial fan-sequels to Don Quixote which was basically the first fan-fiction, and then in 1615 the original author wrote an official sequel in which Don Quixote reads a piece of fanfic about him and sets out on a quest to beat up the author who mischaracterized him

This is all true. What happened more specifically is that one fan fiction got really really popular and since people weren’t all that familiar with how novels worked (because there weren’t really any other novels in Europe yet), a lot of people just took this as a valid sequel. Cervantes (the original author) had pretty much stopped working on any kind of sequel to the original at point, but he got really pissed that people were reading this fan fic and assuming it was as legit as his canon. So he got off his butt and wrote this sequel, which academics call big words like “meta-textual” when really it was Cervantes trying to make sure people understood his canon correctly and didn’t get carried away with their silly fan theories based on this one fic writer’s interpretation. 

Now-a-days, the “true sequel” is normally just lumped in and stuck onto the end as a “part II,” in case you are wondering why you’ve never heard of a Don Quixote the Sequel. By all accounts, the fan fic was pretty bad, which makes it’s a perfect beginning to the grand tradition of fanfiction.

Calling this the first instance of fanfiction, though, comes from the fact that this was the first time, as far as we know, that the author of the original stepped in to officially denounce fan work as not canon. For most of history (at least western history) there wasn’t really an idea that stories had ownership. Most famous greek plays and poems are based on other works. Virgil’s Aeneid can easily be called Homer fan fiction (we have no real way of knowing how much of the story existed in folk tradition and how much he made up). Most of the versions of greek myths you know come from Ovid’s Metamorphosis, which is largely his short fics about other myths. Moving out of the classical world, bible fic constitutes a lot of what literature is for a while. Dante’s  Inferno, specifically, (which is, lets be clear, a self insert fic where the author meets his fave author - so it’s also RPF - and they take a tour through a crossover fic between the Bible, historical fic, and greek myth) was so popular that it’s kind of crossed over into fanon (quick - biblically how many cicles does Hell have? Answer: none, they all come from Dante and in turn Virgil, and eventually Homer…) On the run up to Don Quixote, we have Shakespeare, who adapted most of his plays directly from other works by other people, from which he asked no permission (nor was he expected to.)

The real move that makes this false sequel the first official fan fiction is that the author of the canon material asserted his ownership of the intellectual property that was the characters and the story. Not in the legal sense - there was nothing illegal about this sequel - but in the sense that you could call this sequel “unauthorized.” It’s the beginning of thinking of characters and stories as belonging to a specific person, rather than simply being created by said person.

City of Cleveland charges Tamir Rice's family $500 for killing him

And you thought Chicago cops had a lotta of nerve. And they do. But the City of Cleveland may have them beat.

The City of Cleveland filed a creditor’s claim against the estate of Tamir Rice, the black 12-year old who was fatally shot by police in 2014, for not paying emergency medical service fees, CleveScene reported Wednesday.

The $500 fee is “owing for emergency medical services rendered as the decedent’s last dying expense under Ohio Revised Code,” according to the report.

This is the most recent indignity to be inflicted on Rice’s family since his murder by Cleveland Police Officer Tim Loehmann in November of 2014.  Prior to this, it was the Cuyahoga county prosecutor who brought Loehmann before a grand jury but didn’t actually have the grand jury vote on indicting him.

And before that, it was the city’s answer to the family’s wrongful death lawsuit, saying that the 12-year old Rice was responsible for his own death.

And now, the City of Cleveland wants Rice’s family to pay for the aid that emergency medical service rendered to him seven minutes after he was shot. Seven minutes, because they arrived on the scene three minutes after another law enforcement officer–an FBI agent who was in the vicinity, NOT a Cleveland police officer–provided aid to Rice … four minutes after he had been shot.

Its hard to find such a sad, horrific and twisted case of injustice elsewhere.

Its also hard to find any more words to describe it.

My mom had a Tiny Adventure

My 71-year-old mom installed some bad software that wiped her drivers.  I helped clean her computer out of the badness, but I missed that part.  She emailed me asking for help one day, and I sent her a link to a manual with instructions, and told her I’d come by one evening when she felt up to it to get her set back up.

Well, she emailed me this morning to tell me she’d read the manual herself and installed her own drivers!  My senior citizen mom who has anxiety conquered her own printer!

Awesome!

I once saw someone point out something I hadn’t really considered before- libraries are one of the only places that are warm and dry where you can stay for long periods of time if you have no money. If you’re someone with nowhere to go during the daytime, they provide a safe environment in which to keep a roof over your head for a while- and all while you can access information.

So yes. This.

It’s weird…libraries almost feel /wrong/ now. It’s like I walk in and think “This is great…where do I put my money?”

I used to work on a campus library and if you want someplace to put your money, so to speak, make sure you put books back in the designated areas. I know you think you’re being helpful by reshelving, but even if you pull something out to read a couple paragraphs just stick it in the basket for things you didn’t want. I don’t care if you know EXACTLY where you are. In academic libraries (at least in Texas) our funding was determined by how many books people looked at. So we got additional funding based on books not being reshelved. If there’s a designated shelf/basket for things you don’t want, stick things in it!

What @standbyyourmantis said about not reshelving is true for public libraries, too. Our funding is dictated largely by how ‘used’ we are, so we scan all the items that are laying about as In House Use. That, tied with Reference Count and Door Counter numbers (we have to manually put in the time we take for references) to prove we’re providing a needed service.
We also have to count the number of people who come for our programs, which not only helps funding but shows that the programming/services are needed, as well.
So, basically, if you want to feel like you’re making sure we’re getting paid and staying around, keep these in mind.

You know the fanon that Tony invites everyone to stay at the Tower because he’s lonely when Pepper and Rhodey are busy? What if everyone comes to live there for that reason, and it doesn’t quite work according to plan?

I mean, he has friends around. So many friends! All the time! It’s great! Go team!

Except Pepper is waking up at ungodly hours of the morning to do yoga with Bruce. Or Rhodey and Thor are deconstructing battles instead of watching the movie Tony chose. Or Pepper and Steve talking about art when the whole reason Pepper picks out Tony’s art is that Tony doesn’t care, okay, this is not Tony’s interest. Even Rhodey and Clint discussing the finer points of barbecue- no, not with any robot help, just fire and a grill. It’s not that Tony isn’t invited, it’s just- his life has a very set order. Things are supposed to revolve around him! WHY ARE THINGS NOT REVOLVING AROUND HIM.

He hadn’t realized new friends at the Tower meant new friends for EVERYONE, this is like when Pepper and Rhodey discovered they both liked Walking Dead even though Tony wasn’t into it at all but times like a million.

Some nights, when Tony needs a break from his experiment but Pepper and Natasha are out for drinks and Rhodey and Sam are bonding over being the only normal people in the tower, Tony finds himself hanging around the common room of the tower with Bucky, both of them sulking (although both would fervently deny it), no one talking, no one even acknowledging the other.

JARVIS helpfully plays children’s programs about learning to work together on the television. Neither of them dignifies it with a response.

Yes, this! Especially the part about children’s programs modeling good citizenship and cooperation.
