Apple breaks revenue, iPhone, and iPad records in Q1 of 2014

by Andrew Cunningham

Apple has just released its financial results for the first quarter of fiscal 2014, which runs from the beginning of October to the end of December. The company earned $13.1 billion in profit on a record $57.6 billion in revenue. Both the revenue numbers and the company's 37.9 percent gross margin were in line with the guidance Apple released at the end of last quarter.

As usual, the iPhone, iPad, and Mac were Apple's three biggest revenue drivers. This was the first full quarter of availability for the iPhone 5S and 5C, and new iPads and Retina MacBook Pros were released early in the quarter. Apple sold 51 million iPhones, up from 47.79 million in the year-ago quarter; 26 million iPads, up from 22.86 million a year ago; and 4.84 million Macs, up from 4.06 million last year. These three categories alone make up 87.4 percent of Apple's total revenue. The iPhone and iPad numbers represent new quarterly records for the company, while this is the first significant year-over-year increase in Mac sales the company has experienced in some time.

The iPod continued its long, slow slide this quarter. It sold 6.05 million units, down from 12.68 million a year ago. It's worth noting that Apple didn't refresh the iPod lineup this year, opting to keep its 2012 products around for at least another year. However, the iPod line's sales continue to be eaten up by smartphones and tablets whether new models are released or not. The entire lineup accounted for just 1.7 percent of the revenue pie this quarter, and Apple expects the iPod to continue its decline.

Family sues Uber for wrongful death of their 6-year-old daughter

by Cyrus Farivar

Uber driver 'Syed Muzzafar was using the Uber app while he was driving but did not have anyone in his car at the time of the accident'

'Uber has previously argued that because Muzzafar "was not providing services on the Uber system during the time of the accident,” the company is not responsible.'

Uber maintains that it "does not provide transportation services."

A San Francisco family that lost its six-year-old daughter, Sofia Liu, in a local traffic accident involving an Uber driver last month has now sued the smartphone-enabled black car firm for wrongful death.

On December 31, 2013, Syed Muzzafar was using the Uber app while he was driving but did not have anyone in his car at the time of the accident. Muzzafar was also named as a defendant in Monday’s civil suit.

Uber has previously argued that because Muzzafar "was not providing services on the Uber system during the time of the accident,” the company is not responsible. Andrew Noyes, an Uber spokesperson, declined further comment. He also did not respond to Ars’ question about whether the company’s attitude would be different had Muzzafar been driving an Uber passenger at the time.

shut up.

Not until whoever invented this is in jail

why the fuck bother having a rolling chair

This is the worst

[twitches horribly] oh god, oh god make the nightmare stop

LOOK I MEAN THIS IS JUST CLEARLY A GOOD IDEA TAKEN WAY TOO FAR WHY IS THE DEKS INVOLVED WHY IS IS THE MOTHERFUCKING ***COMPUTER TOWER IN THE SAND*** IT DOESN”T NEED THAT IT TIDNT” ASK FOR THIS

1) make a little tray like, I dunno, THE SIZE OF YOUR FEET, YOUR FEET DON’T NEED THAT MUCH ROOM this is how we end up with Johnny Huge Ballz taking up 3 seats on the subway, reign it in buddy

2) Next to the little sand foot rest, put a little tray of water. Get one of those plastic boot trays, that should be plenty. AGAIN: RESIST OVERKILL FOR FUCK’S SAKE

3) Put a lil towel down next to THAT

So your game goes

- Squirm your toesies in the sand while your work, I dont blame you

- Lift your sandy feets out of the tray, tap them lightly, then set them in the tray of water, give em a swish

- Lift your clean wet feet, tamp them on the towel, ta-da, clean sand-free feet

Obviously this doesn’t work if you have free-roaming pets or children. Also, I personally would be more into just a little moss bed, which would make way less mess, but eh, whatever.

MY POINT IS YOU CAN LIVE SOME VARIATION OF THIS DREAM AND KEEP YOUR MICHEL GONDRY-ESQUE “WHIMSY” WHILE PARTICIPATING IN A SOCIETY THAT IS SYSTEMICALLY DESTROYING YOUR LIFE AND THE LIVES OF ALMOST EVERY OTHER LIVING CREATURE ON THIS PLANET WITHOUT GETTING SAND ALL OVER YOUR STUFF.

Also I don’t like that t-shirt at ALL.

Super Bowl Props: National Anthem betting odds on Renee Fleming

by OddsShark
firehose

gamblers bet on anything

Last year, the Super Bowl national anthem ran long. The popular Super Bowl prop odds favor another long rendition with Renee Fleming doing the honors.

In a surprise move by the NFL, a well known pop star was not chosen to sing the National Anthem at the Super Bowl this year. Instead, professional opera singer Renee Fleming will sing the National Anthem, setting the total sky high at two minutes and 25 seconds.

Four of the last six performances of the National Anthem at the Super Bowl went under two minutes, including Christina Aguilera's infamous performance in which she omitted an entire line of the song.

[ See Super Bowl national anthem prop results since Super Bowl 40 ]

Jennifer Hudson's performance at Super Bowl 43 took 2:10 to complete while Alicia Keys took 2:35 to get through the song last year in one of the most popular pregame Super Bowl betting odds.

What makes this year's total so interesting is the unknown factor of the singer. While most popular artists here have plenty of performances of the National Anthem on YouTube to research, Renee Fleming does not.

Needless to say, a professional opera singer has the voice and range to stretch the song out for as long as she chooses.

Will Fleming use the Super Bowl stage to show off her opera endurance or will she be instructed to sing the National Anthem in a timely fashion? Prop bettors with a hunch should bet on the Over or Under 2:25 accordingly.

Newswire: Warner Bros. may send Guy Ritchie on a quest for six King Arthur movies

by Sean O'Neal
firehose

'a Guy Ritchie-directed remake of Excalibur'

With the growing edict that a movie is not really a movie unless it is six movies, all interconnected by a sprawling mythology, Warner Bros. has naturally been chasing a modern update of the original fantasy franchise that isn’t the Bible: the legend of King Arthur. And while it stopped just short of attempts to develop David Dobkin’s Arthur And Lancelot and a Guy Ritchie-directed remake of Excalibur, Warners is now reportedly ready to commit to a Ritchie-led retelling of Arthurian legend spread across six whole films—to start. Deadline reports that the script for the first chapter has already been drafted by Awake writer Joby Harold, whose only previous dalliance with fantasy involved believing that Hayden Christensen and Jessica Alba could carry a movie, and that this lays out the foundation for at least five more movies to follow, not counting the inevitable Merlin spinoff.

Map of Publicly-Funded Creationism Teaching

by samzenpus
Capt.Albatross writes "At Slate, Chris Kirk presents a map of schools in the USA that both receive public funding and teach creationism. It also shows public schools in those states where they are allowed to teach creationism (without necessarily implying that creationism is taught in all public schools of those states). There is a brief outline of the regulations in those states where this occurs, but the amounts involved are not discussed."

Horrifying Business Cliches We’re All Tired and Terrified Of Hearing

by Mallory Ortberg
Courtney shared this story from The ToastThe Toast:
Once Darius mentioned that whenever someone said "touch base" he visualized two people touching the bases of their penises together, I started doing it, and now meetings are a lot funnier.

business“Let’s make sure that our bases will touch. I will touch your base to my base.”

“Together, we will all circle back. The circle will be mandatory, and it will never end.”

“At the end of the day, it is night, and we are alone in the dark.”

“We have no skin in this game. All of our skin is elsewhere. There can be no skin in the Skinless Games under penalty of flaying.”

“You are the Thought Leader; you must lead our thoughts.”

“I will reach out to you. Let me reach out to you. You cannot keep me from reaching you. We will all reach out to you, and we will touch your base.”

“It is what it is. All things are as they are; nothing can change now. All things same, no things new.”

“We must do that going forward. We cannot look back. We cannot go back. We must go forward, all together; looking back will destroy us. Do not look behind you.”

“You must never go where the rubber meets the road. Your death crouches for you there, whispering your name through its jaws.”

“Soon the COB will come. The Close of Business will be here. We must prepare; we must prepare. There will be no business after the Closing.”

Comcast reportedly wants to nab millions of customers from Time Warner Cable

by Jacob Kastrenakes
firehose

all carriers suck forever
"The deal would give TWC's New York City, New England, and North Carolina cable assets to Comcast if Charter's purchase of TWC goes through"

Charter Communications is reportedly bolstering its aggressive plan to take over Time Warner Cable by bringing Comcast in as backup. According to Bloomberg, Charter and Comcast are close to striking a deal that would sell significant TWC assets to Comcast if Charter's buyout attempt goes through. The deal would both provide Charter with much-needed funding to finance the offer and remove Comcast — a cable provider bigger than both Charter and TWC — from the list of potential bidders. Removing Comcast as a potential buyer will also help Charter convince TWC's stockholders that they're unlikely to see a better bid than what it's offering.

TWC's New York City, New England, and North Carolina assets would go to Comcast

The deal would give TWC's New York City, New England, and North Carolina cable assets to Comcast if Charter's purchase of TWC goes through, reports Bloomberg. TWC is said to have around 3 million subscribers throughout those markets. But Charter's success in buying TWC is still far from certain. Its offer has been rebuffed by TWC three times now, with TWC's executives making it clear that they felt its offer — reportedly $132.50 per share (around $37.4 billion in cash and stock) — was too low. Charter has since begun appealing directly to TWC's shareholders in an attempt to have them begin pushing for the buyout on their own.

According to Bloomberg, TWC's shareholders are looking for at least $140 per share — higher than Charter's latest offer, but lower than the $150-$160 per share than TWC execs have been seeking. Charter will reportedly borrow $20 billion to finance the deal, with funding from Comcast sitting on top of that. For Comcast, making a deal with Charter may also give it a way to get a piece of TWC while avoiding major regulatory hurdles that likely would have threatened the deal had it gone in on its own.

Though Charter is a smaller company than TWC, it appears to see this as an auspicious time to begin building for the future. One of the major catalysts of this aggressive stance is John Malone, the so-called Darth Vader of the cable industry, who's taken a stake in Charter through his Liberty Media investment group. Despite his reputation, convincing enough shareholders will still be a struggle, but we may see how the takeover attempt plays out soon. Bloomberg reports that Charter plans to make a direct offer to TWC shareholders in February, when it'll also try to place its own selections on TWC's board.

Netflix now lets you disable Post-Play to avoid binge watching entire TV seasons

by Chris Welch

If you've binged on a season of House of Cards or Breaking Bad, you're likely familiar with what Netflix calls Post-Play. It's the feature that queues up and automatically plays the next episode of whatever TV series you're currently watching. Netflix does take some measures to ensure viewers haven't nodded off; after two episodes, viewers must confirm they're still watching before streaming continues. And now the company is letting subscribers turn the feature off entirely if they so choose. Disabling post-play is as easy as visiting your account settings and unchecking the "Play next episode automatically" box. Netflix notes that "other Post-Play features will still be enabled," so you may still see details about the next episode appear on screen during the credits — but it won't start playing on its own.

About anonymous sources and Kotaku...

by gguillotte

buried in the smallest headline possible and not on the RSS feed I'm subscribed to

I pride myself in the accuracy of my reporting. I can point to spot-on, anonymously-sourced stories about unreleased gaming hardware or, say, this one about the then-unannounced Titanfall. When I have to use anonymous stories for a story I think is unusually important—such as whether the then-upcoming Xbox One is going to require an Internet connection to start games—I'll do so with as much multiple sourcing and transparency about the sources' identities as possible. I'll check and double-check, as will all my reporters. You can assume our anonymous sources are good (you've even heard of some of them, I bet), and you can rest assured that a slip like Friday's is something I personally will do my best to ensure never happens again. I can't remember a similar situation with my work in the last decade and hope there will be another decade before it happens again. Everyone makes mistakes, but I don't have to be ok with that.

One chart shows how Apple has truly become the post-PC company

by Christopher Mims
Apple’s iPad sales make Mac sales look puny by comparison. Horace Dediu

How can one characterize the post-PC age? This graph of the growth of iPad sales, created by mobile analyst Horace Dediu, compared to relatively stagnant growth in sales of Apple’s Macintosh personal computers, shows that when someone wants an internet-connected device that can perform everyday computing functions, increasingly that device is a tablet. Apple just released its earnings, and while the company missed expectations on iPhone sales, it sold more iPads than expected—26 million versus 24 million. Quartz’s Zach Seward has taken to grouping all of these devices—including the large phones that are a segment of the tablet market—under the term “glass-covered internet machines.”

At this point, it’s worth asking whether or not we’re living in a post-PC age, or whether “personal computer” simply means “tablet and anything else with a 7″ or “bigger screen, keyboard optional.”

A Convention Harassment Policy in Action

by John Scalzi

Arisia is a convention with a harassment policy. So what happened when a woman quite reasonably felt she was harassed, and complained to convention about it? Why, it was handled quickly and efficiently, of course, because there was a process in place to handle it, and that process was followed.

Read about the event here.

Shira Lipkin has further thoughts here.

Good on Arisia for being a convention where someone who felt they were being harassed knew how, and felt comfortable with, reporting the event.
