Here Is How Rand Paul's Bill Would Curtail Civil Forfeiture

Today Sen. Rand Paul (R-Ky.) and Rep. Tim Walberg (R-Mich.) reintroduced the Fifth Amendment Integrity Restoration (FAIR) Act, which would revise federal civil forfeiture law to give property owners more protection and reduce the profit incentive that encourages law enforcement agencies to seize assets. "The federal government has made it far too easy for government agencies to take and profit from the property of those who have not been convicted of a crime," Paul said. "The FAIR Act will ensure that government agencies no longer profit from taking the property of U.S. citizens without due process, while maintaining the ability of courts to order the surrender of proceeds of crime." 

Here are some of the FAIR Act's provisions:

Profit motive. The FAIR Act abolishes the Justice Department's Equitable Sharing Program, which allows police to evade state limits on forfeiture by using federal law to confiscate people's property. That option is appealing because federal law requires less evidence and gives cops a bigger share of the proceeds than many state laws do. While Attorney General Eric Holder's new forfeiture policy deals with a relatively small part of equitable sharing, Paul's bill would eliminate it entirely. The FAIR Act also reduces the Justice Department's incentive to pursue forfeitures by assigning the proceeds to the general fund instead of the department.

Standard of proof. The FAIR Act requires the government to prove by "clear and convincing" evidence that property is subject to forfeiture. The current standard is "preponderance of the evidence," which amounts to any probability greater than 50 percent.

Innocent owner defense. In cases where the government argues that an asset is forfeitable because it was used to facilitate criminal activity, the FAIR Act puts the burden on the government to show, by clear and convincing evidence, that the owner himself used the property for illegal purposes or that he "knowingly consented or was willfully blind to the use of the property." Current law puts the burden on innocent owners to show they did not know about the illegal use or "did all that reasonably could be expected under the circumstances to terminate such use." In other words, property owners are guilty until proven innocent, turning an ancient principle of justice on its head.

Structuring. It is a federal crime to make bank deposits of less than $10,000 "for the purpose of" evading the reporting requirement for amounts above that threshhold. That law has led the IRS to seize money from small-business owners whose only offense was making insufficiently large deposits, a.k.a. "structuring." The FAIR Act would allow forfeiture only when the owner "knowingly" sought to avoid bank reports of "funds not derived from a legitimate source." It requires a hearing within 14 days of the seizure at which the government must show probable cause to believe the money was involved in structuring.

Proportionality. In determining whether a forfeiture is constitutionally excessive, a court is supposed to consider not only "the seriousness of the offense" (as under current law) but also "the extent of the nexus of the property to the offense," "the range of sentences available for the offense," "the fair market value of the property," and "the hardship to the property owner and dependents."

Legal representation. The FAIR act expands the current guarantee of legal representation for property owners who cannot afford it from forfeitures involving primary residences to all forfeitures.

Reporting. In its annal report to Congress on forfeitures, the Justice Department would have to provide separate numbers for criminal forfeitures (which require a conviction) and civil forfeitures (which do not).

"The FAIR Act would provide essential protections for innocent property owners who have for decades lost their cash, cars, homes and other property without being convicted of or even charged with a crime," says Scott Bullock, a senior attorney at the Institute for Justice, which has been fighting forfeiture abuse for years. "This legislation would also go a long way toward stopping the perverse practice of policing for profit.”

69 Percent of Americans, Including 60% of Democrats, Favor School Choice

A recent national survey of U.S. adults finds that school choice is massively popular among every possible group and sub-group. For instance:

When asked, "Generally speaking, would you say you favor or oppose the concept of school choice? School choice gives parents the right to use the tax dollars associated with their child’s education to send their child to the public or private school which better serves their needs," fully 69% support school choice, including 45% who strongly support it, while 27% oppose it. School choice support has strong support across partisan lines; 60% of Democrats, 67% of Independents and 81% of Republicans back it.

These arguments in favor of school choice are popular, according to the pollsters at the Democratic-affiliated firm of Beck Research.

o “Too many students are stuck in failing schools and need help right now. If K to 12 students are not receiving a quality education in their neighborhood public school, parents should have the opportunity to get them a quality education at another school” (50% very convincing, 77% very or somewhat convincing).

o “Opportunity scholarship programs give children from low income families a way out of failing schools so they are not forced to wait indefinitely for their local schools to improve. Students should not be sentenced to a poor Page 3 education based upon their zip code” (49% very convincing, 77% very or somewhat convincing).

o “Vouchers provide an immediate path for children from low income families in failing schools to access a better education. Studies show that children in these programs have higher graduation rates, higher academic achievement and parents are more satisfied with their child's school” (43% very convincing, 76% very or somewhat convincing).

Of course, there's at least one Democrat who emphatically does not support school choice, at least when it concerns kids other than his own. That's Barack Obama, who despite sending his own kids to the pricey Sidwell Friends in D.C. (and a similarly fancy private school in Chicago before that), quickly moved to quash a popular and effective scholarship program that allowed needy children in Washington to attend schools that were otherwise out of reach. Fishing the Edges for Redfish

Sink a fly for bonus hookups on redfish.

On a slick, low-tide flat, you might only get one shot at shallow-water redfish. When the fish move off, what next?

Orange and blue rays of a low sun supplied a picturesque setting as a school of redfish made its way through shallow water near Amelia Island. Multiple subtle wakes disclosed their presence and intentions as we waited patiently with both Power Poles engaged at the deep edge of the flat.

As the reds arrived at the shallow side of an oyster mound, Amelia Island’s Dr. Richard Haines loaded his 8-weight fly rod with a pair of false casts then dropped his black Clouser Minnow fly perfectly in front of the school. Haines made a long strip, resulting in a good hookset, then raised his rod as the fish powered back onto the oyster-laden mud flat. Playing his fish with the line in his hand, Haines brought the fish safely to the boat for release. We hoped for another shot, but the school of reds had simply
disappeared.

“I know exactly where that school has slipped off to,” Haines said while gesturing to a deep slough located between that same oyster bar and a nearby dock. As quick as a redfish sucks in a small blue crab, Haines had retied with one of his special Dr. Jaws Crab pattern flies (good guess: Dr. Haines is a dentist!). Following a perfect cast, Haines allowed his crab imitation to drift slowly into a deep depression that ran between the nearby oyster bar and boat dock. A sharp twitch in Haines’ fly line indicated a redfish had found his crab pattern fly smack in the middle of the 5-foot slough. Another fat Amelia Island redfish was photographed and released.

Haines and I have worked together in designing a crab pattern that slowly drifts deep where there is both current and redfish. The Dr. Jaws Crab is tied on a No. 2 hook employing either 1/24-, or 1/16-ounce lead dumbbell eyes which aid the fly in drifting deep. Also unique is a scent-impregnated orange sponge tied to the shank of the hook and enclosed by a natural colored mesh body. Fish scent may be added occasionally
to the sponge. Orange rubber legs complete this deepwater redfish crab pattern.

Richard Haines of Amelia Island shows a nice redfish caught on a scented, fast-sinking crab pattern.

When fly fishing for redfish that have slipped off the flat, the same 8-weight fly rod and reel with a 9-weight, weight-forward floating fly line can be employed which is also used for skinny water redfish. My fly line of choice is Jim Vincent’s Rio that has a short head for fast casting to redfish and a mid length taper that tends not to spook redfish.

Also, Umpqua’s 9-foot, 16-pound-test “Redfish” tapered leader features a long, heavy butt section that transfers much needed energy from fly line to fly resulting in longer casts in heavy winds.

Finally, in many cases redfish on the edge will hold in water depths of 2 to 5 feet of water where the water is just deep enough to disguise their presence until a flooding tide beckons the school back onto nearby shallow structure. Also keep in mind that redfish schooling at the deep edge of a flat are also pretty consistent in their migration pattern and can be targeted on the fly time and time again. Too much pressure, however, may and most often will prompt the school to find a new deepwater home at low tide. FS

How WhatsApp Web Works

WhatsApp Web does not have all the features of the mobile app. In fact, it can’t work without the mobile app. You will need your phone to connect to and use WhatsApp Web.

This is, in essence, a clone or a mirror of what’s happening on your phone. If a message comes to your phone, you’ll see it in WhatsApp Web. If your phone doesn’t get a message because it doesn’t have an active internet connection or it’s switched off, then you won’t see it in WhatsApp Web either.

This makes WhatsApp Web inferior to other chat apps, but in some ways, it also makes WhatsApp Web more secure.

How to Set Up WhatsApp Web

Once you have these elements ready, setting up WhatsApp Web is simple:

  1. Open the browser on your PC and go to web.whatsapp.com.
  2. You will see a QR code that you need to scan to connect to WhatsApp Web.
  3. On your WhatsApp mobile app, tap Menu > WhatsApp Web to start the QR code reader.
  4. Point your phone’s rear camera to the QR code on your PC screen.

As soon as WhatsApp Web scans the QR code, it will connect your phone to your PC. In a jiffy, WhatsApp Web and WhatsApp mobile will be synced. You are now ready to use WhatsApp online through the computer.

What You Can Do With WhatsApp Web

  • Use your keyboard to type.
  • Access media (photos, videos, audio) in-line. You can also download any media directly to your PC. However, you cannot bulk download all media files; you have to manually click each.
  • View videos from Facebook, Instagram, and YouTube without leaving the chat window, through Picture-in-Picture mode.
  • Start a new conversation with any contact, or search for existing conversations.
  • View contact information.
  • Start a new group chat, talk in group chats, and view group information.
  • Connect multiple computers to your phone and save them for future. You can also remotely disconnect any browser from your phone.
  • Get or mute desktop alerts and sounds.
  • Share photos and videos, documents, and contacts.
  • Send emojis, GIFs, and stickers, as well as voice notes.
  • View WhatsApp Status updates from any contact.
  • Select multiple messages, and clear messages.
  • Reply, forward, star, or delete messages.
  • Edit your profile.

What You Can’t Do With WhatsApp Web

  • You can’t send a WhatsApp Broadcast.
  • You can’t make or receive WhatsApp Voice calls or WhatsApp Video calls.
  • You can’t post new WhatsApp Status updates.
  • You can’t share maps or your current location.
  • You can’t change media download settings, so all photos and videos sent to you are downloaded automatically.
  • You can’t use two browsers at the same time. While you can add multiple browsers/PCs to your phone, you can only use one at a time.
  • Settings are limited to notifications through WhatsApp Web and chat wallpapers.

Using Multiple WhatsApp Accounts

You can use multiple accounts with WhatsApp Web on one computer

Some folks have two numbers associated with two different WhatsApp accounts. You can still control WhatsApp online for both on a single PC.

To do that, you will need to open WhatsApp Web in two different browsers, such as Chrome and Opera. Alternately, you can open WhatsApp Web in an incognito window, but that automatically logs you out after an hour.

What Makes WhatsApp Web Special

WhatsApp Web is special because of the keyboard, you can finally type fast

So why should you use WhatsApp Web when it’s more limited than the phone? Because of the keyboard, of course.

If you want to engage in long conversations with someone, it’s easier to type using a keyboard. In fact, WhatsApp Web also works with WhatsApp Business, and you’ll be glad that you can take care of multiple customers through it.

You can use keyboard shortcuts too. The most useful two to remember are Ctrl + Shift + [ to go to the previous chat, and Ctrl + Shift + ] to go to the next chat.

How Safe Is WhatsApp Web?

While it initially got some flak for its lack of security, WhatsApp now boasts end-to-end encryption for all of its messages. This extends to WhatsApp Web as well.

Still, it’s a good idea to employ the best security practices for WhatsApp and understand how safe your photos are in WhatsApp, whether you’re using it your phone or using WhatsApp Web. For example, if you have to use WhatsApp Web on a different computer, always open it through an incognito window.

How to Log Out of WhatsApp Web

If you are using WhatsApp Web on your own computer, you can stay logged in even when you are done. It’s convenient.

If you are using it on someone else’s computer, then remember to log out after you are done using WhatsApp online. It’s best to do this on both the computer and the mobile app.

  2. To log out of WhatsApp Web through your phone, go to Menu > WhatsApp Web > Log out from all devices. As the name indicates, this will close WhatsApp Web on any computer you are logged in.

A Whale of a Boat.

On a recent episode of Comedians in Cars Getting Coffee, Jerry Seinfeld rolled around Montauk while interviewing Jimmy Fallon. The episode featured a whole lot of star power for one small web short (not to mention one very tiny car) but both celebrities still managed to get upstaged by the unlikeliest of cameos – a boat. But, not just any boat, a thirteen foot Boston Whaler which Seinfeld proudly called, “the greatest boat in the world.” For as hyperbolic as that may sound, Seinfeld’s claim is one-upped by an even bolder statement from the Boston Whaler company itself – that their boats are “unsinkable legends.”

That phrase (which is their officially trademarked tagline) reflects the bombastic attitude which has kept Whaler afloat for nearly sixty years. Created by Dick Fisher, a natty Harvard grad in 1958, the Whaler was a lightweight, foam-core boat with a non-traditional shape which made it extraordinarily buoyant. Fisher’s true skill though, was in marketing, as epitomized by the now legendary 1961 print ad in which he confidently took a chainsaw to one of his thirteen foot creations. The boat stayed afloat and the Whaler company became known across the seafaring community for their unconventional and unsinkable dinghys.

That unsinkable claim no longer holds the weight it once did though, as the Coast Guard now requires all motorboats boats to meet this standard, but the Whaler company has not lost their founder’s boastful spirit. In 2007 they even updated Fisher’s chainsaw routine by shooting a nineteen footer in a half with an M60. That boat, of course, stayed afloat. To this day recreational boat-lovers around the world are still drawn to the Whaler’s unorthodox designs and even more unorthodox attitude. And as Seinfeld points out, the logo is pretty damn cool too.
