Lawsuit says Fitbit overestimates sleep by 67 minutes per night

Hahah I'm going to feel a little bad if I got a full refund on my Force, and then also sign up for the class action and get paid when I actually really liked the product.

A Florida man has filed a lawsuit (PDF) against Fitbit, saying the company's claims that its devices can track sleep are false.

The plaintiff, James Brickman bought a Fitbit Flex in 2013. His case is seeking class-action status, hoping to represent consumers who bought any of Fitbit's line of products that include sleep-tracking technology. Those models include the Fitbit Force, Flex, One, and Ultra and 2nd-generation devices like the Charge and Surge.

The suit says that Fitbit devices "consistently overestimated sleep by 67 minutes per night," as compared to polysomnography, the most accurate type of tracking used by sleep scientists. Compared to actigraphy, a less-accurate measure, the Fitbit still overestimates by 43 minutes per night.

Armed with GoPros and flanked by a professional camera team, Rossy and his protégé Vince Reffet do some stunning tricks and stunts while flying at 120 miles per hour through the hot Arabian sky.

"We're just lucky guys," Yves says in the video. We'd call you something else, but let's not let jealousy take hold.

Pretty solid list. Though Angry Birds and Minecraft might be too new IMHO.

For all of the game industry's myriad "game of the year" lists and "official" awards from various bodies, as well as ephemeral "best ever" lists from various media outlets, there have been precious few organized attempts to establish a permanent, concrete gaming "canon," comprised of titles that truly represent the medium. That's set to change soon, as the Strong National Museum of Play (which also houses the International Center for the History of Electronic Games) has announced the first 15 finalists for induction into its new World Video Game Hall of Fame.

Those nominees are:

  • Angry Birds
  • DOOM
  • FIFA
  • The Legend of Zelda
  • Minecraft
  • The Oregon Trail
  • Pac-Man
  • Pokémon
  • Pong
  • The Sims
  • Sonic the Hedgehog
  • Space Invaders
  • Super Mario Bros.
  • Tetris
  • World of Warcraft

The finalists were chosen from among thousands of public nominations by an internal advisory committee at the museum. That committee looked for games that met four criteria: "icon-status" (i.e., wide recognition), longevity ("more than a passing fad"), geographical reach, and overall influence (on games, entertainment, pop culture, etc.). A game with great influence could get into the Hall of Fame even if it didn't meet the other three criteria, the Strong said.

Konami delists itself from the New York Stock Exchange

As Konami faces down the cancellation of the anticipated Silent Hills and an apparent labor dispute with storied developer Hideo Kojima, the venerable Japanese publisher has voluntarily decided to delist itself from the New York Stock Exchange, effective this coming July.

Konami will still be traded on the London and Tokyo Stock Exchanges, and it will still be available as an "over the counter" trade in the US, according to a corporate release. And while Konami will no longer be required to file regular financial and business updates with the SEC following the delisting, it promises to "continue to disclose financial statements and other information, in English, on its website to ensure that its overseas shareholders and investors will continue to have appropriate information about the Company."

In a statement provided to Game Informer, Konami noted that it expanded to the New York Stock Exchange in 2002 "mainly to diversify its opportunities for fund-raising and to raise the visibility of the Konami brand." Since then, Japanese stocks have been opened to foreign investors, and updates to Japanese accounting standards have put the country more in line with those in the US, Konami said. Overall, less than 0.3 percent of the company's total international trading takes place in the US—the vast majority of the rest goes through Tokyo—meaning the New York listing is "not economically justified," according to the company.

Vaccine campaign leads to elimination of rubella in the Americas

Yesterday, the World Health Organization (WHO) got together with the Pan American Health Organization to announce some promising news: there have been no new transmissions of the rubella virus in the entire Western Hemisphere since 2009. As a result, the virus has been declared eliminated in this region, joining smallpox and polio on that elite list.

Rubella, commonly called the German measles, doesn't cause severe symptoms in the vast majority of infected individuals. If a pregnant woman is infected, however, the disease can cause miscarriages or a suite of birth defects. Before the advent of an effective vaccine, the WHO says that up to 20,000 children a year in Latin America and the Caribbean were born with rubella-related birth defects; that's also the number that occurred during the last major outbreak in the US.

The widespread use of the MMR vaccine (measles, mumps, and rubella) is partly to thank for the virus' elimination. Caribbean countries also used an adult vaccination program to help cut transmission in their populations. As a result, the last infection with a local origin occurred in 2009. Since then, several cases have been reported within the hemisphere, but all have traced back to infections overseas.

We'd built this elastic band ball together over the course of about a year, buying big bags of elastic bands every so often and just slowly adding them all onto the ball. Eventually, we got bored of it and it was also getting quite difficult to find elastic bands that could still make it all the way round so we stopped expanding it and it got left under a table for about a year.

After a while, the elastic on the outer layers got frayed and started snapping by itself, so every day there'd be a few more snapped elastic bands on the floor. We decided to get rid of it, and I suggested cutting it in half somehow.

After the video above went viral last December, he uploaded more footage showing what the rubber band ball looked like before he cut into it.
