In February, before Bard launched, an internal group was warned not to release the chatbot due to its perceived low quality. Despite this warning, Bard went on to launch a month later. The corporate culture exhibited is one that appeases profitability rather than worrying about the ethical implications of their AI creations.

A concerning position

Google’s stance and behaviour towards addressing implications of ethical concerns is concerning. One worker who asked to work on machine learning was repeatedly discouraged to the point of detriment in their performance reviews, while others complained that ethical considerations were obstructing their “real work”. Due to scandals such as AI chatbot misconduct that produces savage, and disgraceful output that is unflinchingly wrong, misleading or offending its audience, rushing chatbots into the market could lead to serious issues. Bloomberg has revealed Google’s less than desirable approach to ethical considerations, and will concern the public further if they do not take responsibility for their actions.

The rapid rise of AI language generation platforms such as GPT/ChatGPT, Stable Diffusion, Midjourney, and others has disrupted old copyright, intellectual property, and fair usage conventions. This development is partly due to the law’s slow, precedent-driven evolution. Whenever there are legal grey areas or loopholes, someone will exploit them. In this case, tech companies scraped pre-2021 web data to train AI systems, and the arts community became the easiest target. These companies bet that ownership issues would be too diverse and diffuse for the legal system to catch up quickly. Unfortunately, they may be right. As a consequence, the law may have no choice but to create a regulatory patch or levy – a temporary solution for a much larger problem.

One of the critical questions that lawmakers must ask themselves is: when is an AI-generated work considered derivative? Any content produced by a generative AI trained on existing human content will always be derivative, especially if explicitly instructed to mimic an existing body of work. Yet, software companies claim otherwise. This viewpoint is unconvincing so far, but it’s up to litigation to decide. On some social platforms, there is an increasingly common view that all artwork is derivative on some level, which denigrates the human capacity for original thought and experience. Others argue that if a creative person can be replaced by an AI-generated tool, then they weren’t talented enough to begin with. This faulty logic was disproved in January 2021 when artists took legal action against Stability AI, Midjourney, and artist platform DeviantArt. The lawsuit alleges that their content was scraped, allowing AI systems to reproduce any artist’s style, including those working today. In summary: uniqueness and skill make work more likely to be copied and devalued, not less. The more visible the content online (more metadata), the bigger the target for scraping.

If tech companies are correct, the question becomes, who owns the rights in a generated work? The software provider, employer, the prompter, or the source material’s creators, which is sometimes unknown? Or is it no one? Trillion-dollar corporations trivialize ownership issues until their patents are copied. However, for independent, creative individuals, copyright issues may represent their livelihood and intellectual property. Dismissing their complaints is akin to ignoring their lived experiences, including their need to pay bills and taxes.

AI technology is on the cusp of irreversibly damaging the human experience. It implicitly devalues human emotions, experiences, and skill, thereby diminishing the art and craft of human talent, which were previously more highly prized or seen as defining the human condition. Will it be exciting or interesting when AIs start recycling AI-generated content, producing an infinite regress of material based on other AIs’ output? What will happen when there is little to no link with humanity? It remains to be seen. The legal system offers checks, balances, and remedies, but it progresses case by case. It offers little in the way of global regulatory solutions when companies opt to scrape the web to train large-scale language and generative AIs. The content may have been on a public domain, but that doesn’t mean that it was public-domain data in legal terms.

One of the main challenges with Big Tech platforms is their global reach, while local legal systems’ nuances differ. For post-Brexit UK, which promised a bonfire of EU regulations, the jurisdictional concerns are adrift, and nobody knows whether their allegiances remain with Europe, the US, or their new trade allies in Asia. However, there are facts governing generative AI data analysis and mining. In 2014, the UK introduced a fair use exception for text and data analysis. This exception is limited to non-commercial purposes and is intended primarily for academic purposes. It only applies to fully accessible works that can be mined and does not cover commercial or exclusive content.

If fake stories become training data for AI systems, newer versions of AI will be “poisoned” with lies. All publishers should take this as a warning and pause for thought so as not to engage in terrible practice, regardless of how the fallacious material is produced.
