Steve Ballmer: Google Is A Monopoly And Should Be Investigated By The Government (MSFT, GOOG)

Microsoft CEO Steve Ballmer thinks that Google is a monopoly and that the government should step in and do something about it.

So he said on Thursday at Microsoft's analyst conference in Bellevue, Wash. He was discussing how so few companies have grown really huge by offering cloud services to consumers, even though there are a few up-and-comers like Facebook.

Of all the markets Microsoft plays in, and it pretty much hits them all (devices, software,  cloud for consumers and the enterprise), Ballmer says that making money in consumer cloud services is the toughest.

"Google does it. They have, dare I say, a monopoly. We are the only company on the planet still trying to compete with it," he said.

And Microsoft is pressuring the authorities to investigate Google when it comes to search:

This [search] is a scale game because the market for advertising is auction-based economics. If we have exactly the same quality of algorithms but less scale in search advertising we get less revenue per search than Google which means they have more money to pay for distribution on Samsung or Apple. Rumor is they pay each $1 to $3 billion a year for distributing their search products. We have to generate volume to step up.

I believe that Google's practices are worthy of discussion with competition authority. And we have certainly discuss them with competition authorities. I don't think their practices are getting less merit tortuous of discussion. We highlighted some bad practices in advertising and discussions with regulators, the bundling they're doing with You Tube and Google Maps. I think they need pressure from competition. I think they need pressure in the marketplace with product, with investment, with scale. How do we get scale? On our own devices or on somebody with whom we're closely aligned.

That's rich and ironic coming Ballmer. Microsoft was under scrutiny in the U.S. for a decade after the Department of Justice declared it was a monopoly and was violating anti-trust law by bundling Internet Explorer with Windows. As late as March of this year, EU regulators were still fining Microsoft for not keeping its anti-trust agreement with them.

Still, Microsoft could get its way. All kinds of government agencies have been listening and saber rattling around Google, threatening investigations into this or that. Some of them have ended more-or-less in Google's favor, like an FTC investigation in January that found Google was not abusing its search engine to favor advertisers.

PS4's Japan delay due to a lack of Japanese games

The late launch of the PlayStation 4 in Japan is, in part, a response to the lack of games aimed at Japanese consumers from Japanese developers, Sony Computer Entertainment senior VP Masayasu Ito told Polygon in an interview today.

Third-parties in Japan have been focusing their efforts on portable platforms like PlayStation Vita, Ito said in a roundtable discussion at Sony's headquarters today, and many haven't "embarked on the development of PS4 titles." The February 2014 launch of PS4 is timed with the availability of certain Japanese software titles, he said.

Here's The Moment Syria Decided To Build A Massive Chemical Weapons Arsenal

syria hafez assadIsraeli investigative journalist Ronen Bergman has published a comprehensive history of "the Israeli-American efforts to penetrate the Assad regime."

The reports details several subterfuges, sabotages, and assassinations in Syria that arose as a result of Israeli intelligence.

It also explains when and why Syria decided to build a huge chemical weapons arsenal.

In 1990 the Syrian regime of Hafez al-Assad became impressed with the "American mighty war machine" after the Syrian 9th Mechanized Division joined (but did not fight with) the U.S.-led coalition forces against Iraq's Saddam Hussein in the Gulf War, Bergman writes.

Assad subsequently concluded that America's military prowess implied that Israel also had much better weapons than Syria and the gap couldn't be closed in the near future, according to a series of high-level 1991 meetings intercepted by Israeli intelligence.

From Foreign Policy:

Thus, Assad decided to invest in a powerful missile arm — a division of the air force, but under his direct command and led mainly by loyal Alawites like him. Assad also decided that the missiles that the arm deployed would be tipped with lethal chemical warheads.

The investment in missiles was based on the assumption presented by Assad at the meetings that the Syrian air force was not capable of penetrating Israel's air defenses, but showers of missiles laced with chemical warheads could do so.

Bergman, citing Israeli intelligence, writes that Syria began producing missiles with the help of North Korea as well as chemical warheads for Scud missiles with the assistance warheads Soviet Union, China, and Czechoslovakia.

At the same time the Assad regime was buying chemicals from private individuals and companies in Western Europe and Japan.

By the time Bashar al-Assad succeeded his father in 2000, Syria was well on its way to amassing what is considered the third-largest chemical weapons stockpile in the world (behind the U.S. and Russia).

Interestingly, in early 2013 year Israeli President Shimon Peres described to Bergman a chemical weapons "red line" that Assad seems to have crossed on August 21.

"If the Syrians dare to touch their chemical weapons and aim them at us or at innocent civilians, I have no doubt that the world as well as Israel will take decisive and immediate action," Peres said.

That "decisive action" now hinges on the "nightmare" process of securing and destroying Syria's massive arsenal.

A Homeless Florida Man Is Alive Because Of Bitcoin

Wired reports on a Pennsacola, FL man named Jesse Angle who earns Bitcoins however he can. They quite literally help keep him alive.

Using the free Wi-Fi in an area park called Martin Luther King Plaza, Angle watches YouTube videos for roughly five cents worth of Bitcoin per pop as part of a service called BitcoinGet, a means to artificially drive traffic to video content, but it's one of Angle's sources of Bitcoin income.

He can watch up to 12 videos a day, netting him 60 cents at a time. He also uses Bitcoin Tapper, an app that dispenses fractions of Bitcoins with every tap of an icon.

Since setting up his Bitcoin wallet three to four months ago, Angle has grinded it out to earn somewhere between $500 and $630 of the digital currency. Bitcoin income supplements his food stamps and affords him a bit more comfort as he goes about his life.

There's a really cool Pennsacola charity called Sean's Outpost that takes donations for the homeless in Bitcoin instead of regular currency. So far the organization has raised $32,000 worth of Bitcoin for the area's homeless.

Gold iPhones Are Going For $1,800 On eBay

Today was the first day the iPhone 5C and 5S went on sale at the Apple Store and it was no surprise that around 11 a.m. this morning, Apple called it: it was sold out of the 5S, the top-of-the-line iPhone that boasts the fingerprint scanner. 

Even harder to find? The gold iPhone 5S. 

So we took to eBay to see if anyone was selling one, and found 1,469 listings.

Here are some of the ones we saw:

Here's How The Marine Corps Will Take The Next Step Toward Integrating Women Into Combat

As the Pentagon seeks to integrate women into combat capacities in the coming years, the Marine Corps has been experimenting with running women through its existing combat training regimens.

For more than a year, the Marines have experimented with passing women through the Corps infantry officers course. Of the 10 lieutenants who have tried, just one passed the initial combat endurance test. She dropped out shortly thereafter due to injury.

And as the Corps continues to grapple with women in its Infantry Officer's Course, it announced this summer that it would begin allowing women to try the enlisted equivalent — the School of Infantry. The Marines, however, stated that even if women were able to successfully complete the 60-day course, they would not be granted access to the field.

There was also some debate about where the women would come from. Could any female enlisted Marine of any rank in any occupational field raise her hand and seek to enroll in SOI? The answer is no, Dan Lamothe at the Marine Corps Times has learned.

The women who will attempt to pass through the School of Infantry will entirely be made up of recent graduates from Boot Camp, Lamothe writes, citing an unnamed source. The course, which takes place on a satellite base near Camp Lejeune in North Carolina, has no grueling entry test like it's counterpart for officers. There are, however, several days in the field, and hikes ranging from 5 to 20 kilometers in distance.

Limiting the participants to newly-minted Marines is smart for a couple of reasons. First, they're generally in better physical condition than Marines who have been in the fleet for a couple of years, having just completed a pretty grueling 13-week training program. Secondly, it will be less disruptive to their careers, not pulling a higher ranking Marine away from her unit for a two month experiment. 

The first Marines, who will all be privates and privates first class, will begin training next week. They all volunteered, Lamothe writes.

NASA Will Pay You $170 Per Day To Lie In Bed

If you have the stamina to lie in bed for 70 days straight, NASA will pay you $18,000 — no joke.

It's actually called the "Bed Rest Studies — The Exercise Study (CFT 70)."

They say the study is "designed to minimize loss of muscle, bone and cardiovascular function through high intensity interval-type aerobic exercises on alternating days, with continuous aerobic exercise daily."

Here's the full description. They write:

This study will show how much your body, tilted down slightly with head down and feet up, for 70 days, 24-hours a day, without getting out of bed, except for limited times for specific tests, is like an astronaut’s body during the weightlessness of space flight. Watching you will help scientists learn how an astronaut’s body will change in weightlessness during space flight in the future.

During your off time you get to play on your phone, read books, skype, take online classes, or anything else you want... as long as you don't stand up. I'm pretty sure you would have to have a catheter and a solid waste collection bag, and NASA has created a special shower gurney for washing.

After the testing phase you will have another few weeks of recovery days in which the scientists study how your body adapts to being out of bed. They pay $1,200 a week for the duration of the test — usually 15 weeks.

Simulate getting out of a vehicle. Moving heavy objects at a short distance. This gives us an idea as to their functional capabilities."

Previous volunteer, and now NASA contractor, Heather Archuletta, told Forbes: "The day I got up, after being in bed for 54 days [the study was cut short by Hurricane Ike], my feet hurt like crazy walking for the first time! But, I reminded myself, this is what astronauts go through, too."

DEFCAD Launches ‘The Pirate Bay’ of 3D Printing

download a carLate last year the 3D print website Thingiverse decided to ban 3D gun designs, citing their terms of service which clearly prohibit files used to make weapons.

In a response Defense Distributed, the people behind the first 3D printable gun, threw up a website to host the designs that had been banned at Thingiverse. This included the popular blueprints of their own gun “The Liberator.”

The worldwide release of the prints did not sit well with the State Department’s Office of Defense Trade Controls who kindly requested that DEFCAD remove the availability of the 3D printable gun documents, citing a possible violation of International Traffic in Arms Regulations.

The files in question were removed, but at the same time DEFCAD was already working on a new project that would be harder to censor. Defense Distributed founder Cody Wilson had started to raise funds for a separate meta-search engine, the first to focus on 3D print models.

“In March of this year, seeing an opportunity to expand the DEFCAD concept to fight the prevailing ideas about intellectual property in the entire physible space, I split Defense Distributed and DEFCAD and turned the latter into another company,” Wilson tells TorrentFreak.

“The idea was to move away from direct hosting to employ the first amendment victories won by Google in the courts and become a meta-search engine as a more robust way of spreading and preserving physibles. We hope to build a piece of infrastructure to help stem the next wave of the IP wars in advance, if you will.”

DEFCAD raised a significant amount of funds and has now quietly rolled out the meta-search engine to the public on DEFCAD.com. While still labeled as an Alpha release the site already indexes more than 74,000 files, all stored on external sites.

DEFCAD has been labeled the “Pirate Bay of 3D printing” as Wilson and his team previously pledged not to take any content down. Those who take a good look at the site will also notice some other Pirate Bay references, including the “kopimi” logo at the bottom and the use of magnet links. In addition, many of the files linked on DEFCAD are hosted on the Bayfiles hosting site which was launched by two Pirate Bay founders.

While DEFCAD doesn’t mind being linked to The Pirate Bay, Wilson believes that the title doesn’t apply as much after they were forced by the authorities to censor their own work. He sees the Pirate Bay comparison mostly as “convenient headline writing,” which we were kind enough to make use of.

“After the State Department came after Defense Distributed and our hand was forced, I believe the Pirate Bay is still the Pirate Bay of 3D sharing. But nothing would be better than building complementary structures in the spirit of TPB,” Wilson says.

The involvement of government changed a few things, and unlike The Pirate Bay, the company has registered Wilson as DMCA agent to deal with takedown requests. While they initially received some complaints from Thingiverse users, DEFCAD has not yet received a single official DMCA takedown notice.

“There was some dissatisfaction with our public testing earlier in the summer. A handful of makers felt like we were taking advantage of Thingiverse’s bandwidth or not adequately respecting their ‘rights’ to their ‘property,’ but since we’ve appointed a DMCA agent we’ve received no takedown requests.”

Of course it is still early days for 3D printing and at the moment the scale of 3D print piracy is rather minimal. This is bound to change in the years to come, but DEFCAD’s founder doubts that it will ever compete with the size and prevalence of more traditional forms of piracy, such as sharing movies and music.

“I’m of two minds about this right now. Having grasped the state of 3D printing at the top and the bottom, I think the deck is stacked against movement physible piracy,” Wilson tells us.

“What I mean is that I don’t see the same passions being exercised to liberate copyrighted design as I see used to liberate entertainment media. This is probably obvious, and it may mean nothing for the future political defense of the physible, but I think the distinction is worthwhile.”

Wilson expects that when the ball starts rolling the entertainment industry might be the first to jump in to protect their 3D designs, as they have done already on a small scale.

“It’s interesting that the old movie and film giants were the first to issue physible takedown notices. It’s quite likely entertainment-related physibles are going to be the battleground in the near future,” Wilson says.

Earlier this year HBO was one of the first to issue a 3D print takedown request for a Game of Thrones iPhone cover. Those who search DEFCAD for the name of the popular series will see that they have plenty of work to do.

For now, however, the most downloaded files on the new meta-search engine are, perhaps fittingly, guns. With more than 6,000 downloads The Liberator v1.1 is the most popular, followed by other gun designs, the FOSSCAD Atlas SSR and DMR Shanrilivan with over 5,000 downloads.

Of course there are thousands of other designs available as well, and for the pacifist pirates out there DEFCAD also has plenty of booty.

Three men impersonate cops to cut GTA 5 waiting line

Three Staten Island men have been charged with second-degree criminal impersonation after posing as police officers to obtain copies of Grand Theft Auto 5 without waiting in line, reports Silive.

The NYPD report that the three men — one of which is an auxiliary member of the NYPD, while another is a retired officer's son — arrived at the Staten Island Mall just before midnight Monday night in a police car purchased at an auction with a "lights-and-siren package installed."

SimCity collaboration with Red Cross to provide real-world assistance

SimCity players who purchase and download Red Cross-branded digital content will be able to help people affected by real-world disasters, Maxis Emeryville general manager Patrick Buechner announced.

Content will be available for one year beginning today, though players who purchase it will have it for life. The DLC adds a Red Cross Relief center, tents and two vehicles, which appear when in-game disasters strike.

"Sims that would otherwise have been critically injured are instead offered aid at the Red Cross relief tents," Buechner wrote. Just as promised, today ASUS has made its new PadFone Infinity official in Taipei, and there are definitely no surprises in the specs. The main update here is obviously the 2.2GHz quad-core Snapdragon 800 SoC, along with the addition of a microSD slot plus a secondary microphone for noise cancellation. Unsurprisingly, the internal storage options have been lowered to 16GB and 32GB, which is understandable with that new storage expansion capability.

One very subtle change that we missed in the leaks is the new diamond cut on the metallic backside, which gives the phone a more premium and solid look than the original version. To accompany that, the new PadFone Infinity comes in two new color options: “Titanium Black” and “Platinum White.”

The software has also been given a gentle facelift, courtesy of a more consistent design language throughout the system — from the simplified icons to the UI of some of the built-in Android apps. Since this is based on Android 4.2 instead of 4.1 out of the box, we should also see some performance boost as well. The good news for existing users is that the original PadFone Infinity will also receive this update, but there’s no time frame for the roll-out just yet. %Gallery-slideshow84453%

Total War: Rome 2 patch improves AI waiting times

Creative Assembly today released Patch 2 for its historical strategy epic Total War: Rome 2.

The patch seeks to minimize calculation times during AI turns; a common complaint about the game has been extended periods of players waiting for enemies to get on with their business. Sega released the Windows PC game earlier this month.

Additionally, a new "Limited" option has been added to the "Show AI Player Moves" settings which enables the player to see all movement of enemy factions in home territories.

Various AI improvements have also been added, prompting enemies to behave more rationally when under threat. Unit movement speeds have been tweaked. A full (and detailed) list of the fixes has been posted on the Total War Wiki.

Angry entrepreneur replies to patent troll with racketeering lawsuit

Most business owners sued by patent trolls don't talk about it to anyone other than their lawyer; a typical response is to cross one's fingers and hope the problem goes away. It won't, of course. Often they do the next best thing—hope it will go away for as little money as possible.

FindTheBest CEO Kevin O'Connor, who also cofounded online ad giant DoubleClick, decided several weeks ago he would talk about it—publicly, and often. O'Connor wrote to tech sites like PandoDaily telling them of his determination to "slaughter" the troll, the "scum of the earth." And in August, he pledged $1 million of his own money to fight the troll that went after his company.

Now, we're getting a vision of how FindTheBest is putting that money to use. The company has made a novel legal claim, saying that the troll that came after it is so reckless, it has engaged in outright extortion, violating racketeering laws.

Newell teases announcement about 'bringing Linux into the living room'

At LinuxCon today, Valve head Gabe Newell hinted at an impending announcement that may reference his comments from CES 2013 about creating a Steam Box console that runs Linux, Ars Technica reports.

"Next week we're going to be rolling out more information about how we get there and what are the hardware opportunities we see for bringing Linux into the living room," Newell said.

Newell made his statement at LinuxCon in New Orleans, an annual event for analysts, developers, operators who work with the open source ecosystem.

"It feels a little bit funny coming here and telling you guys that Linux and open source are the future of gaming," Newell said. "It's sort of like going to Rome and teaching Catholicism to the pope."

Amazon vinyl sales up 745 percent since 2008, but it won't save music

Here's more fodder for those who argue that a large number of consumers still want physical media: vinyl sales at Amazon are up 745 percent from five years ago, the company said this morning. "Vinyl is the fastest growing music medium on Amazon," the company stated.

Amazon also said that vinyl is the most popular medium within AutoRip, the feature that provides customers with free MP3 copies of select vinyl albums or CDs they purchase from the online store. Amazon's reported growth in vinyl sales is consistent with an industrywide trend. Nielsen SoundScan estimates that vinyl unit sales will grow to 5.5 million in 2013.

Two Of Twitter's Earliest Workers Didn't Get Any Of The Company's Stock In Upcoming IPO

When Twitter's IPO launches and its stock becomes publicly traded in a few months, the offering will create several instant millionaires. CEO Dick Costolo, who provided $25,000 in early investment money, has a stake worth about $10 million, according to The New York Times.

But the Times also found a couple of workers from the early days of Twitter who didn't get any stock. One was Dom Sagolla, the former head of quality at Odeo from 205 through 2006. Odeo was the forerunner company to Twitter. He told the Times:

“To see it come to life and have it taken away, I was devastated,” said Dom Sagolla, an early employee of Twitter who was laid off in May 2006 and never received stock. While Mr. Sagolla has made some money by proxy from Twitter — he wrote a book that tells newcomers how to use the service and is doing some paid public speaking — he does not stand to benefit as Twitter heads to Wall Street.

Another was Florian Weber, a German programmer contractor. Weber was a lead developer at both Odeo and Twitter. The Times says:

And then there were those who never got any stock at all, like Florian Weber, one of the earliest programmers at the company. He worked on the project before it was even fully separate from Odeo, the now-defunct company where it was hatched.

Mr. Weber, a German citizen, said he was hired as a contractor, not an employee, so he never received any stock options.

“Coming from Germany, it’s not something that I pushed terribly hard for,” said Mr. Weber, who often worked remotely from Hamburg and eventually tired of telecommuting.

“As far as I know, I’m the only one who does not have stock options,” he said. But he has no regrets. He eventually started his own company, Amen, in Germany, which was just sold to a bigger firm, Tape.tv. “I’m very happy with my life.”

The Times explains that in its early days, Twitter struggled and laid people off to conserve cash.

League of Legends Championship Series matches recreated in Legos

In case regular League of Legends Championship matches weren't interesting enough, YouTube user danmovproduction created Lego renditions of several plays.
