White House may back down on border-wall funding

(CNBC) — The White House suggested Tuesday that President Donald Trump could back down from his demand for $5 billion to fund his proposed border wall in a year-end spending bill.

Trump’s push for the money has threatened a partial government shutdown when funding for seven agencies lapses after midnight Friday. Last week, the president said he would be “proud” to close parts of the government over border security.

“We have other ways that we can get to that $5 billion that we’ll work with Congress,” White House press secretary Sarah Huckabee Sanders told Fox News on Tuesday morning. She added that the Trump administration could support $1.6 billion in border security funding proposed by Democrats, as long as it can “couple that with other funding resources” to get to $5 billion.

A Southern California man has become the latest person to sue the federal government over what he says is an unconstitutional search of his phone at the Los Angeles International Airport.

According to his lawsuit, which was recently filed in federal court in Los Angeles, Haisam Elsharkawi had arrived at LAX on February 9, 2017 and was headed to Saudi Arabia to go on a hajj, the Muslim religious pilgrimage.

After clearing the security checkpoint, Elsharkawi, an American citizen, was pulled aside from the Turkish Airlines boarding line by a Customs and Border Protection officer, who began questioning him about how much cash he was carrying and where he was going. Elsharkawi complied with the officer’s inquiries and dutifully followed him to a nearby table.

(HELENAIR.COM) — A Helena man target shooting on public land near Helena reported being shot at multiple times by another man who “mistook him for Bigfoot.”

The man, who identified himself to dispatchers as being 27 and from Helena, was reportedly setting up targets on BLM land in the North Hills when, he says, a bullet hit about 3 feet to his left, and then another bullet hit to his right before he ran to cover and heard more shots.

The Helena man told dispatchers he then confronted the shooter, who told him he was “not wearing orange and thought he was Bigfoot,” according to Lewis and Clark County Sheriff Leo Dutton.

Napolitano Sides With Comey After His Tirade Against Republicans: ‘I Can Understand His Frustration’

When Fox News host Melissa Francis tried to mock former FBI Director James Comey‘s scathing comments from Monday afternoon, Fox News legal analyst Judge Andrew Napolitano came to Comey’s defense.

On Tuesday afternoon’s edition of Outnumbered, Francis tried to mock Comey’s explanation for why he waited to tip off the Justice Department ahead of Michael Flynn’s January, 2017 FBI interview.

“I knew that if anything came of the interview, if it advanced our investigation, the attack from the Trump Administration would be that an Obama holdover had engineered it,” Comey said Monday. “And so I had to make the decision, separate from her, to leave them with their only opportunity to challenge it would be to burn down the entire FBI. To my shock and horror, they’ve tried to do just that — in the face of silence from people in this building.”

“It seems like James Comey loves to go and stand in front of a camera, and talk about why he had to usurp someone else’s authority — In this case, not telling Sally Yates was going on — in order to save the republic,” Francis said.

But Napolitano leapt to Comey’s defense, telling Francis “I thought Comey was pretty cogent in what he said. I can understand his frustration.”

“All the questions are coming from Republicans, and they seem to be politically motivated,” Napolitano continued, then went after Donald Trump and the Republicans.

“The attacks on the FBI, the efforts to undermine it by the chief law enforcement of the United States, the president, has been met with silence from the supposedly law and order Republicans,” he said. “That is the take away that I got from what Comey just said.”

Kroger-owned grocery store begins fully driverless deliveries

Nuro, a startup founded by two veterans of Google's self-driving car project, has reached an important milestone: it has started making fully autonomous grocery deliveries on public streets.

Fry's Food, a brand owned by grocery giant Kroger, launched a self-driving grocery delivery program back in August in partnership with Nuro. Fry's has been using Nuro cars to deliver groceries to customers near one of its stores on East McDowell Road in Scottsdale, Arizona.

Initially, these deliveries were made by Toyota Priuses that Nuro had outfitted with its sensors and software. There were also safety drivers behind the wheel. Nuro says it has made 1,000 deliveries using these vehicles since August.

It Looks Like Trump Won't Shut Down the Government Over Border Wall Money

With a little over three days to go before a partial government shutdown, White House Press Secretary Sarah Huckabee Sanders suggested the Trump administration is willing to compromise.

President Donald Trump has demanded that a spending package to keep the federal government fully funded after Friday include $5 billion for construction of his proposed wall on the U.S.-Mexico border. "I am proud to shut down the government for border security," he said last week during a televised Oval Office meeting with Senate Minority Leader Chuck Schumer (D–N.Y.) and House Minority Leader Nancy Pelosi (D–Calif.), who generally oppose the wall funding.

But today, Sanders appeared to reverse course. "We have other ways that we can get to that $5 billion," she said on Fox News. "We will work with Congress if they will make sure we get a bill passed that provides not just the funding for the wall, but there's a piece of legislation that's been pushed around…that provides roughly $26 billion for border security including $1.6 billion for the wall," she said.

As Politico notes, Sanders was likely referring to a compromise bill pushed for by Senate Democrats but rejected by Republicans who wanted the full $5 billion. Democrats no longer support that deal, instead proposing $1.3 billion. However, it's conceivable they could reconsider.

"That's something that we would be able to support as a long as we can couple that with other funding resources," Sanders said regarding $1.6 billion in wall funding. "At the end of the day, we don't want to shut down the government, we want to shut down the border."

Of course, it's not exactly clear what those "other funding sources" would be. A person briefed on talks between congressional Republicans and the White House suggested to The Washington Post that reallocating money that's already been approved could be one option. According to Politico, the money could come from the Pentagon's budget.

The New York Times, meanwhile, reported that Senate Majority Leader Mitch McConnell (R–Ky.) met with Schumer today and proposed setting aside $1.6 billion for non-wall-related border security, in addition to $1 billion that Trump could spend however he likes on immigration. However, congressional Democrats have said they won't support that plan.

Clearly, things are still up in the air when it comes to a spending package that would keep the government fully funded. Different numbers are being thrown around as both parties in Congress and Trump try to come to an agreement. What does seem clear, however, is that the Trump administration wants to avoid a shutdown.

This is significant, especially in light of Trump's previous declaration that he would be "proud" to let a shutdown happen. As recently as Sunday, White House senior adviser Stephen Miller was saying publicly that his boss would "absolutely" shut down the government over border wall funding.

The fact that negotiations are happening at all is a sign that Trump is folding. His previous position was that any sort of deal would have to include $5 billion in border funding. Now he appears to be backing off, with Sanders talking very generally about "other funding sources."

This is a positive development. As I wrote on Friday, both building Trump's border wall and shutting down the government are bad ideas. Ideally, Trump would give in completely, thus stopping a shutdown and preventing money from going to the border wall. In the end, Trump may get some money for the wall, but it probably won't be $5 billion. And as long as a deal can be reached before midnight on Friday, the shutdown will be a crisis averted.

This post has been updated to note that congressional Democrats have rejected a plan that would set aside $1 billion for Trump to spend however he likes on immigration.
