Einen Pflichtverteidiger gibt es erst, wenn mindestens ein Jahr Freiheitsstrafe zu erwarten ist. Mehr als ein Orientierungssatz ist das aber nicht. Das Gesetz kennt andere Konstellationen, in denen man an einen Pflichtverteidiger kommen kann – dann kommt es nicht auf die Höhe der zu erwartenden Strafe an. Ein ganz wichtiger ist die „Schwierigkeit der Sach- oder Rechtslage“.
Im Blog meines Kollegen RA Detlef Burhoff wird ein interessanter Fall beschrieben, der sich genau um diese Schwierigkeit der Sach- und Rechtslage dreht. Es ging um Fahrerflucht. Die Halterin des Pkw erzählte auf der Polizeiwache munter drauflos, der Polizist hörte ihr freundlich zu. Erst nachdem sich die Frau um Kopf und Kragen geredet hatte, belehrte der Beamte die Frau über ihr Schweigerecht. Obwohl im schon lange vorher hätte klar sein müssen, dass die Frau Beschuldigte ist.
Genau so läuft es Tag für Tag an Unfallstellen und auf deutschen Polizeiwachen. Nicht nur in Verkehrssachen. Aber schon diese alltägliche Konstellation, nämlich den Beschuldigten erst mal plappern zu lassen und ihn nicht rechtzeitig über seine Rechte zu informieren, macht die spätere Beiordnung eines Verteidigers notwendig. So zumindest das Landgericht Hannover in einem aktuellen Beschluss (Aktenzeichen 70 Qs 6/17). Das Gericht fasst die Gründe für die Beiordnung so zusammen:
Die Angeklagte, die über keine juristische Vorbildung verfügt, wird die sich vorliegend mit der Einführung und Verwertung von Beweismitteln stellenden Rechtsfragen nicht beantworten können.
Zur Ausrichtung der Verteidigungsstrategie ist eine Auseinandersetzung mit der Frage, ob ein Berufen auf ein Beweisverwertungsverbot verfahrenstaktisch sinnvoll ist, unerlässlich und nur nach Rücksprache mit einem Rechtsanwalt zu beantworten.
Fernerhin können die insofern relevanten Rechtsfragen regelmäßig nur nach vollständiger Aktenkenntnis geprüft werden. Unter Zugrundelegung dieses Beurteilungsmaßstabs ist nach Gesamtwürdigung der Sach- und Rechtslage eine Pflichtverteidigung vorliegend geboten, weil die Annahme eines Beweisverwertungsverbots jedenfalls ernsthaft in Betracht kommt.“
Insgesamt eine gute Nachricht für Betroffene, die nicht das nötige Kleingeld für einen Anwalt haben.

Das GPD Pocket ist ein extrem kleines Notebook, auf dem wahlweise Windows 10 oder Ubuntu zum Einsatz kommt. Wir verraten euch, was im Inneren des Winzlings steckt.
GPD Pocket: Das Jackentaschen-Notebook bekommt besseres Keyboard
Dass Bedarf an einem wirklich kleinen Notebook besteht, das die Besitzer einfach in ihre Jackentasche stecken können, konnten aufmerksame Beobachter bereits bei der Vorstellung des GPD Win sehen. Das Gerät war allerdings vor allem für Gamer gedacht, weswegen sich die Tastatur den wenigen Platz mit den Tasten eines Gamepads teilen musste. Das Ergebnis war ein Keyboard, dass eher zu einem alten Blackberry als einem Notebook gepasst hätte. Diesen Fehler hat jetzt auch der Hongkonger Hersteller eingesehen, und mit dem GPD Pocket einen deutlich interessanteren Nachfolger vorgestellt.

Beim GPD Pocket nimmt die Tastatur im Grunde den gesamten verfügbaren Platz ein. Nur ein Trackpoint, wie wir ihn vor allem von Lenovo kennen, hat sich dazwischengeschmuggelt. Im Vergleich zum GPD Win dürfte der Tippkomfort daher deutlich größer sein. Das kommt auch auf Indiegogo an. Auf der Crowdfunding-Seite kamen bislang mehr als 660.000 US-Dollar für die Produktion des Winzlings zusammen. Dabei läuft die Kampagne noch etwa zwei Monate. Zum Vergleich: Für das GPD Win gingen insgesamt Zusagen für etwas weniger als 720.000 US-Dollar ein.
GPD Pocket: Das steckt im Inneren des Winzlings
Der sieben Zoll große IPS-Touchscreen löst mit 1.920 mal 1.200 Bildpunkten auf und liegt geschützt unter Cornings Gorilla Glass 3. Die Außenmaße des aus einer Magnesiumlegierung gefertigten Notebooks liegen bei 180 mal 106 mal 18,5 Millimeter. Das GPD Pocket wiegt 480 Gramm. Als CPU kommt Intels Atom-x7-Z8750-Prozessor zum Einsatz, der auf 1,6 Gigahertz getaktet ist. Ihm zur Seite stehen acht Gigabyte Arbeitsspeicher und eine SSD mit 128 Gigabyte Speichervolumen.
Neben Bluetooth und WLAN gibt es einen USB-3.0- und einen USB-Typ-C-Anschluss. Außerdem verfügt das GPD Pocket über einen Kopfhörer-Anschluss sowie einen Mikro-HDMI-Port. Der festverbaute Akku bringt es auf 7.000 Milliamperestunden und soll das Notebook für etwa zwölf Stunden mit Saft versorgen können. Das Gerät kann wahlweise mit Windows 10 Home oder Ubuntu 16.04 LTS (Xenial Xerus) bestellt werden. Beim Keyboard stehen euch allerdings keine Auswahlmöglichkeiten zur Verfügung: Die Tastatur des GPD Pocket soll leider nur mit US-Layout ausgeliefert werden.
Preise für das Mini-Notebook beginnen bei 399 US-Dollar
Das GPD Pocket soll später für 599 US-Dollar in den Handel kommen. Über die Indiegogo-Kampagne wird es derzeit jedoch für 399 US-Dollar angeboten. Beim Preis spielt es bemerkenswerterweise keine Rolle, ob ihr das Gerät mit Windows 10 oder Ubuntu bestellt. Ausgeliefert werden soll das winzige Notebook ab Juni 2017. Wie bei allen Crowdfunding-Kampagnen dieser Art besteht aber natürlich immer ein gewisses Risiko, dass das Gerät erst später oder schlimmstenfalls gar nicht beim Käufer ankommt.
Viele hunderttausend Internetkunden können von einem Gesetz profitieren – das sie womöglich noch nicht mal kennen. Seit August letzten Jahres ist der Routerzwang entfallen. Das heißt, Provider dürfen ihren Kunden nicht mehr die Nutzung spezieller Hardware vorschreiben. Will der Kunde ein eigenes kompatibles Gerät betreiben, muss ihm die Firma die nötigen Zugangsdaten zur Verfügung stellen.
Insoweit ist die gesetzliche Regelung (§ 11 Abs. 3 FTEG = Gesetz über Funkanlagen und Telekommunikationseinrichtungen) endeutig. Umstritten ist, für wen das Gesetz gilt. Nur für Neukunden? Oder auch für Altkunden? Das Landgericht Essen wählt nun die großzügigere Lösung (Aktenzeichen 45 O 56/16).
Es geht um die Auslegung des Satzes: „Notwendige Zugangsdaten und Informationen für den Anschluss von Telekommunikationsendeinrichtungen und die Nutzung der Telekommunikationsdienste haben sie dem Teilnehmer in Textform, unaufgefordert und kostenfrei bei Vertragsschluss zur Verfügung zu stellen“. Das war bisher auch so interpretiert worden, dass die Regelung nur für Neuverträge gilt.
Nach Auffassung des Gerichts kann die Regelung so ausgelegt werden, dass Altkunden ebenfalls Anspruch auf die Zugangsdaten haben. Das entspreche dem Zweck der Regelung. Der Routerzwang sei eine rechtswidrige Einschränkung des Kunden, unabhängig vom Zeitpunkt des Vertragsschlusses.
Microsoft hat eine Reihe von Open-Source-Tools zum Trainieren von Drohnen, Robotern und selbstfahrenden Autos in einer Betaversion veröffentlicht. Auch schnelleres Programmieren wird damit möglich.
Microsoft bringt Open-Source-Toolbox
Forscher von Microsoft haben eine Toolbox angekündigt, mit der Entwickler Roboter, Drohnen und autonome Fahrzeuge testen und den Umgang mit Hindernissen trainieren können. Die Tools stehen in einer Betaversion als Open-Source-Projekt auf Github zum Download bereit.

Sie sind Teil der neuen Microsoft-Plattform Aerial Informatics and Robotics, die auch Anwendungen bieten soll, mit denen das Schreiben von Programmen zur Kontrolle selbstfahrender Fahrzeuge erleichtert wird, wie Microsoft mitteilt. Ziel sei es, „eine Standardisierung von Protokollen und Schnittstellen für autonome Geräte in der realen Welt zu fördern“.
Damit Roboter, Drohnen und selbstfahrende Autos sicher durch den öffentlichen Raum navigieren können, müssen entsprechende Fertigkeiten wie das Erkennen von Bäumen oder Verkehrsschildern gezielt trainiert werden. Der auf der Plattform verfügbare Simulator soll auch kleine Details wie Schatten und Reflektionen darstellen können. Damit ließen sich „sichere, verlässliche und preiswerte Testumgebungen für autonome Systeme“ aufbauen, meint Microsoft.
Microsoft: Code für Drohnen-Kontrolle schneller schreiben
Darüber hinaus bietet Microsoft eine Reihe von Anwendungen, die eine schnelle Codeproduktion für die Kontrolle von Drohnen auf den beiden populären Plattformen DJI und Mavlink ermöglichen. Damit soll es nicht mehr notwendig sein, sich spezifische APIs anzueignen und separaten Code für jede Plattform zu schreiben.

For organizations that are using synchronized identities for Office 365, the directory synchronization tool of choice these days is Azure AD Connect. To keep AAD Connect running you may eventually have the need to move it to another server. There are a variety of scenarios where this need arises, for example migrating to a new server provides the opportunity to safely upgrade to a newer underlying operating system without the risk of a lengthy outage.
For this demonstration, I’ll be migrating Azure AD Connect from a Windows Server 2012 R2 server to a newly installed Windows Server 2016 server. The new server has been configured with an IP address on the network, joined to the domain, updated from Windows Update, and is ready to go. Although it is supported to migrate between AAD Connect instances that are not the exact same build, it is recommended to use the same build on both servers so that the same features and options are available on both instances. In my case, the latest available build is already running on the source server.
The steps to migrate Azure AD Connect to a new server are:
Review the configuration of the existing Azure AD Connect instance
Install the new Azure AD Connect instance in staging mode
Compare configurations of the old and new servers
Swtich-over synchronization to the new server
Decommission the old server
Reviewing the Configuration of the Existing AAD Connect Instance
Ideally you will already have a documented configuration for your AAD Connect instance. If you don’t, then you can use the AADConnectConfigDocumenter tool from MIcrosoft to create a HTML document of your existing configuration. Download their latest release and follow the instructions to generate the report.
If you prefer something simpler to look at, open Azure Active Directory Connect on your existing server, and from the Tasks list select View current configuration. This won’t tell you absolutely everything about the server configuration, but it’s a start. You can also choose Customize synchronization options from the Tasks list to see things like the OU filtering that is configured.
Personally, I prefer the HTML report as it contains everything, it’s just a little harder to read.
Install the New AAD Connect Instance in Staging Mode
On the new server that will be hosting the AADConnect instance, download the latest build of the AADConnect installer and launch it to begin the installation process.
At the Express Settings dialog, choose Customize so that you can fully customize the AADConnect install.
As you step through the custom setup you’ll be able to choose the same configuration options as your existing AADConnect instance. At the final stage, check the box to enable staging mode.
Compare Configurations of the Old and New Servers
The AADConnectConfigDocumenter script can compare configuration information from two different AADConnect instances so that you can find any differences and correct them. The documentation explains how to do it, which I’ll briefly summarize here as well.
First, on the old server I run Get-ADSyncServerConfiguration to export the server’s configuration. I’m placing the export files in the \Data\ESPNET\S1DC1 folder (ESPNET is the NETBIOS name of my domain, and S1DC1 is the old server’s name).
Next, I copy the files to the new server, which is named AAD01, and run Get-ADSyncServerConfiguration again, this time placing the export files in the \Data\ESPNET\AAD01 folder.
Next, I edit the AzureADConnectSyncDocumenter.cmd file that is provided with the script, and supply the folder names of the two configurations that I want to compare.
Save the changes and run the file. It takes a few moments to analyze the data.
After the script has finished running, you’ll find the HTML report in the \Report folder. Open the report in a web browser and review it for any differences between the two configurations, which will be highlighted like the examples below.
Correct any configuration differences (other than obvious ones like staging mode being enabled/disabled), then you’ll be ready to switch-over synchronization duties to the new AADConnect instance.
Switch-Over Synchronization to the New AADConnect Server
Currently the demonstration environment has the following servers installed with AADConnect:
AAD01 (new server) – Synchronization enabled, staging mode enabled
While the two servers are in this state, the new server AAD01 will stay up to date with the latest changes in the on-premises Active Directory and Azure AD. However, it will not export any changes to the directories until staging mode is disabled. Before taking the new server out of staging mode, we first need to place the old server into staging mode so that we don’t have two servers trying to export changes to the directories.
During the switch-over, which is a pretty quick process, there’ll be no synchronization of changes between directories. This might mean a delay in the synchronization of a recent change that one of your administrators made (e.g. a group’s membership) or synchronization of a changed password. Keep in mind though that most changes have a synchronization delay anyway, since the sync schedule runs every 30 minutes. Password changes sync nearly instantaneous though, so that’s got a slightly higher risk of being impacted. To reduce the likelihood of the switch-over impacting someone or something important, you might prefer to schedule the change to occur during a period of low usage in your environment, such as an evening or weekend.
On the old server, launch Azure AD Connect and choose Configure, then from the Tasks list choose Configure staging mode. Click Next, and follow the wizard to authenticate and configure staging mode to be enabled. At the final step you can decide whether to keep synchronization enabled or not, depending on whether you think you might need to switch back to this server again (e.g. if the switch-over is only for DR, testing or site maintenance purposes).
On the new server, launch Azure AD Connect and choose Configure, and again from the Tasks list choose Configure staging mode. Follow the same wizard as before to disable staging mode on the new server, and make sure to start the synchronization process.
Decommission the Old AADConnect Server
When you’re satisfied that the new AADConnect instance is successfully synchronizing your directories, you can decommission the old instance of AADConnect if you no longer have a need for it. The uninstall process can be initiated from the Control Panel in Programs and Features.
When you start the uninstall of Microsoft Azure AD Connect you’ll be prompted to also remove the additional components that were installed on the server for AADConnect, such as SQL instance and the Microsoft Online Services Sign-In Assistant. You can remove them if you no longer have a need for them (e.g. the sign-on assistant is still needed by some PowerShell modules, so if you’re going to keep using the server for admin tasks or scripts, either leave that component alone or reinstall it afterwards).
After the uninstall has finished you can go ahead with any server decommission tasks you need to complete for your environment.
I have been running for awhile now, and have gone through many ebbs and flows with my running love affair. There have honestly been more times when I hate running than times when I like it. I know that sounds like a horrible thing for a “runner” to say, but for me, it’s the truth and I’m owning it. I would MUCH rather sit on the couch and watch Hulu than go outside and sweat, be uncomfortable, and bored for an hour. However, the things I DO love are the benefits of running. For me, running is just the necessary evil to get there.
I love the post run high, the extra energy it gives me, the calorie burn, and the competition aspect. I love the comradery with other runners, the race expos, and the bling. Some of you may be nodding right along with me, especially the beginners who feel like it will be impossible to ever get up to a “far/long run”, or feel like they love it. Unfortunate reality: you may never actually love it. However, that’s ok! You have two choices: 1.) Find something else to do 2.) Do it anyway because you love what it GIVES you, even if you don’t love the act of actual running.
I’m here to give beginners my best advice if you decide you do want to try out the running thing (even if you are currently hating it).
1.) Make a list: What is it you are hoping to accomplish with running? Why did you or do you want to start? Sometimes having a clear and concise reason can help get you moving when you want to take a nap instead. Maybe you want to lose weight, or maybe you just need some alone time. Some people start running to be social with a running group, and some want killer legs. All are valid reasons. You as an individual need to have a goal or focus on WHY you lace up or it may be stuff to stick with it.
2.) Start Slow: Trying to do too much too soon is not only overwhelming (and dumb! Injuries suck!) But it can cause you to give up before you have even gotten started because it seems too hard. Gradual build ups are best mentally and physically. Start with a walk and throw in a few 20-30 second jogs every now and then. Count mailboxes. Tell yourself you will run for ten mailboxes then walk for 20. Get creative but don’t over do it trying to get results faster.
3.) Schedule your runs and keep track: I am a numbers nerd, and seeing my progress on a piece of paper (or in a spreadsheet for you non paper people) makes me want to keep going so I don’t “lose” my progress. Keep track of how long you go for, and your time. Also be sure to schedule your runs into your planner (or Google calendar, whatever my tech savvy friends are using these days), so that you will actually do it. Heck this blog started because I used it as an accountability journal. I said I was going to run in a blog post, so then I knew I had to follow through.

4.) Talk to a running friend: For some reason, we humans like talking to people who have gone through a hard thing that we may be currently dealing with, and have made it out the other side. It’s comforting to know we aren’t alone, and that success is possible. Find a running friend or online buddy who has accomplished a certain goal you want to reach (a time goal, distance goal, whatever!) and pick their brain. It will give you confidence you keep going!
5.) Picture that end result and just do it: I know this seems pretty basic, but it’s just truthful. Think about why you are doing this, then suck it up buttercup and run. You will feel better when it’s over. I have never regretted a run once I was finished. That’s a true story!
Note: There are people who just LOVE running, and that’s awesome too! There have been times in my life I was that person, but overall, I have to really psych myself up for the actual run portion. I much prefer the results, the social aspect, the races, and the bling as mentioned before. We are all unique and different and that’s what is awesome! This post is not meant to knock anyone who truly enjoys the act of running, but instead to motivate those who are struggling some (or most) days.

Bislang stand das Windows Insider-Programm für alle Nutzer zur Verfügung, die ein Windows 10-Gerät verwenden. Nachdem sich die Anwender für das Windows Insider-Programm registriert haben, können sie in den Einstellungen unter Update & Sicherheit direkt ihre Geräte für den Erhalt von Vorschauversionen des Betriebssystems aktivieren.
Der Großteil der IT-Administratoren wird diese Funktion direkt für die Unternehmensrechner deaktiviert haben, immerhin sind vor allem die Fast Ring-Builds nicht gerade zuverlässig. Microsoft will in den kommenden Monaten eine Option für Unternehmen schaffen, das Windows Insider Programm für Unternehmen in die Upgrade-Pläne zu integrieren.
Bislang hat das Unternehmen Redmond allerdings nicht allzu viele Details bekanntgegeben und man dürfte noch in der Vorbereitungsphase sein. Die Bundesagentur für Arbeit (BA) hat nach einer Pannenserie ein millionenschweres IT-Projekt gestoppt. In der Software war nicht einmal das nachträgliche Ändern einer Kontonummer möglich.
Eine 60 Millionen Euro teure Software, mit der auf einer einzigen Plattform auf 14 verschiedene Anwendungen zugegriffen werden könne, werde nun doch nicht in den Arbeitsagenturen eingesetzt, berichtete ein Sprecher der Nürnberger Bundesbehörde am Mittwoch. Korrektur einer Kontonummer nicht möglich
Nach Angaben des Sprechers hatte sich das bei der BA unter der Bezeichnung „Robaso“ firmierende Projekt nach der vierjährigen Laborentwicklung im praktischen Einsatz als nicht „ausreichend flexibel“ erwiesen. Es habe sich gezeigt, dass nachträgliche Änderungen, etwa die Korrektur einer Kontonummer, in dem System nicht möglich sei. Das Projekt habe sich noch in der Pilotphase befunden.
Um eine solche Angabe dennoch korrigieren zu können, habe man sämtlich Leistungs- und Vermittlungsdaten in das System neu eingeben müssen. Da eine Behebung des Fehlers zu aufwendig und zu teuer sei, werde das Systen nun doch nicht in der Praxis eingesetzt. Heute werden in fast jedem Ermittlungsverfahren Computer, Festplatten und sonstige Datenträger beschlagnahmt. Das ist oftmals eine gute Gelegenheit für die Ermittler, um gegenüber dem Beschuldigten die Kostenkeule zu schwingen. Wenn er nicht kooperiert, werden seine Computer halt ausgewertet. Und zwar gerne von einem „Sachverständigen“. Was am Ende sehr, sehr teuer werden kann. Denn die Kosten eines Sachverständigen muss der Beschuldigte zahlen, wenn er verurteilt wird. Nicht zahlen muss er die Ermittlungskosten der Polizei, welche die Computer ja auch auswerten könnte.
Rund 10.000 Euro berechnete zum Beispiel ein Sachverständiger, der im Rahmen eines Verfahrens wegen Kinderpornografie angeblich viele Stunden lang die Speichermedien des Beschuldigten durchforstete. Sein Auftrag erstreckte sich im wesentlichen darauf, möglicherweise strafbares Material oder sonstiges Beweismaterial (zum Beispiel Chatverläufe, E-Mails) auszusortieren und die fraglichen Funde in einer Excel-Tabelle zu notieren.
Ist das schon die Tätigkeit eines Sachverständigen? Oder nicht doch eher nur eine technische Dienstleistung? Das Oberlandesgericht Schleswig-Holstein hat sich des Falles angenommen. Und es trifft eine erfreuliche Entscheidung. Nach Auffassung der Richter kann man nur von einem Sachverständigengutachten im Sinne des Gesetzes ausgehen, wenn der Untersuchende die Ermittlungsbehörden durch besonderes Fachwissen unterstützt. Das sei jedenfalls nicht so, wenn mit einer handelsüblichen Software Datenmaterial bloß gesichtet und „vorsortiert“ werden. Wesentlich mehr hatte der hier tätige Sachverständige aber nicht geleistet.
Der entschiedene Fall ist zwar unappetitlich. Allerdings haben die Erwägungen des Gerichts nichts mit der Materie Kinderpornografie zu tun. Vielmehr lassen sie sich auf alle Fälle übertragen, in denen Angeklagte nach einer Verurteilung für umfangreiche IT-Auswertungen zur Kasse gebeten werden sollen, obwohl die Polizei dies ebenso hätte erledigen können (Aktenzeichen 2 Ws 441/16 (165/16)).

I ran into an interesting issue while I was removing an Exchange 2016 server from an environment. The uninstall process failed on step 5 of 13 and threw an error. The error itself is not all that important for this article, since there are many different errors that might put you in the same position I found myself in, rare as that may be.

Thinking back to other Exchange setup-related disasters I’ve encountered, I remembered that Exchange stores some information about setup progress in the registry. There’s a tip about it here on the Exchange Masters blog. Setup is failing on the Front End Transport service in my case (see above), which is the “FrontEndTransportRole” in the registry.
After removing the Action and Watermark entries, I tried the Exchange install again. This time setup was able to complete the installation, which repaired the server. I was then able to run setup again to uninstall the server, which was successful.
Now, during all this I was asked whether we could just power off the server and remove it using ADSIEdit. As you hopefully already know, removing an Exchange server (or really, doing anything at all) in ADSIEdit is an unsupported method. Sure, there’s lots of war stories out there where people have gotten away with it and everything has continued to work okay in their environment (as far as they can tell), but I would never recommend it and certainly don’t do it for customers.
If you did have a server that was beyond repair and wanted to cleanly remove it from your environment in a supported manner, the correct approach is to use a recovery install. Recovery installs are available for all of the current versions of Exchange, and there’s really no excuse for not doing one if the scenario calls for it.
