Facebook now under fire for Deep Spying

Facebook is facing growing negative reaction to its privacy intrusions.

Joseph Farah, WND founder and CEO, explained in a commentary this month how Facebook and Google, “sharing an ultra-left worldview, dominate both advertising revenues and control of the distribution of content in America and throughout the Western world. Add Amazon to the mix and the deck is so stacked against independent media voices and freedom of speech that the First Amendment could soon become a meaningless, irrelevant relic. Together, the three companies, are without question the most important media companies in the world – even though they aren’t known for creating content.”

Those trends certainly impact consumers, with the loss of choice, alternative voice and freedom of expression.

But a new court fight is developing in which Facebook is accused of tracking consumers’ online movements, even if they’re not logged in to the online social media site.

The Electronic Privacy Information Center, EPIC, revealed it has filed a friend-of-the-court brief in the 9th U.S. Circuit Court of Appeals where arguments are being held soon on a case brought by Perrin Aikens Davis, Brian Lentz, Cynthia Quinn and Matthew Vickery against Facebook.

“At issue is whether Facebook violated the privacy rights of users by tracking their web browsing even after they logged out of the platform,” EPIC explains.

The U.S. District Court for the Northern District of California had dismissed the claims, asserting “users should develop countermeasures to assert their privacy rights.”

EPIC has argued on behalf of internet privacy since 1997, when it conducted the first privacy survey of frequently visited websites and identified the risks that “cookies” would be used to track consumers.

A few years later, it filed the first Federal Trade Commission complaint against a company for cookie tracking.

The Facebook actions deserve a significant response, the organization argues, because the company hides behind “like” buttons on their pages, and “secretly and surreptitiously builds detailed profiles on users even when they are no longer using the service.”

“This is precisely the type of invasive business practice that privacy laws were enacted to limit,” EPIC told the appeals court.

“Users expect that their web browsing history will remain private – no one imagines a marketing executive standing over their shoulder and taking notes as they use the internet – but the lower court improperly assumed otherwise, a clear error at the motion to dismiss stage.”

The filing explains: “Over the last two decades, the persistent tracking of internet users has grown more sophisticated and more secretive. A technique that was originally developed to assist users complete purchases on a particular website has been transformed into a method for tagging, tracking and monitoring people as they move across the network. Even technology experts with access to sophisticated privacy tools lack the ability to limit many of these new tracking techniques.”

The so-called “persistent identifier,” also known as a “magic cookie,” maintains the identity of the web user.

But the big companies immediately jumped on the opportunity and began not only helping users at websites, but tracking them everywhere.

In the two decades since it started identifying the problem, EPIC said, things have changed.

“Consumer tracking and profiling have proliferated in ways that would have been unimaginable to consumers at the time. Methods of web tracking have evolved beyond simple cookie tracking: companies now employ browser ‘fingerprinting,’ use invisible images called ‘pixel tags’ or ‘web beacons,’ collect unique device identifiers associated with users’ computers and phones, and use email addresses and other persistent identifiers to profile users.”

Facebook has established a reputation for deceiving users and, as a result, settled FTC in 2011 of privacy violations.

The company, however, simply refused to follow the terms of its own settlement, and just this year it was found to have allowed political data mining firm Cambridge Analytica access to personal details of 87 million users.

More investigations followed.

But that makes the lower court’s conclusion that consumers should “have taken steps to keep their browsing histories private” wrong, the brief said.

“It is unreasonable to expect the average user to understand the various plug-ins, applications, and complicated settings necessary to prevent advanced tracking techniques,” the brief argued. “Sophisticated users are frequently overwhelmed by the complexity and pervasiveness of these practices. Second, any user hoping to defeat tracking over time would need to constantly survey the field of emerging tracking techniques and develop new countermeasures.”

Scott Pruitt Reportedly Tried ‘Ratf*cking’ Ex-Staffer He Made Fetch a Used Trump Hotel Mattress

In the latest report on Environmental Protection Agency administrator Scott Pruitt’s slimy practices, as he is reportedly directly involved in the “ratfucking” of former aides who attempted to blow the whistle on his shenanigans.

According to a report from The Daily Beast, the former attorney general of Oklahoma attempted to ensure that his ex-scheduling director Millan Hupp, who resigned after blowing the whistle on Pruitt demanding a Trump International Hotel mattress, cannot find future work in Washington, D.C., as he called an influential conservative group and other figures to claim that Hupp is untrustworthy.

Ex-high level EPA officials described this, and other moves by Pruitt, as “ratfucking.”

The EPA chief’s former deputy chief of staff Kevin Chmielewski was also allegedly the victim of similar attacks. Since Pruitt believed that Chmielewski was leaking damning information regarding his unethical spending and travel budget, he advised his press shop to leak information about the ex-staffer to news outlets in an effort to presumably harm his career.

Other staffers were victims of this line of attack, per sources who talked to The Daily Beast to say that Pruitt told aides to pitch “oppo hits” on ex-EPA officials who he took personal issue with.

An EPA flack responded to The Daily Beast‘s request for comment by repeating the statement Pruitt gave in front of the House committee earlier this year:

“I am not afraid to admit that there has been a learning process and when Congress or independent bodies of oversight find fault in our decision-making I want to correct that and ensure that it does not happen again. Ultimately, as the Administrator of the EPA, the responsibility for identifying and making changes necessary rests with me and no one else.”

This report comes after Pruitt has been accused of everything from spending six figures on first-class flights, to allegedly using aides like servants and demanding they fetch him his favorite snacks and treats.

CNN’s Toobin: ‘Why Does Fox News Make Fun of Me For Saying Abortion Will Be Illegal?’

On CNN, legal analyst Jeffrey Toobin on Thursday wanted to know exactly what was wrong with his saying that abortion is going to be made illegal now that President Donald Trump has another Supreme Court pick.

In a discussion on the potential nominee for the Supreme Court, CNN’s New Day panel addressed, somewhat defensively, the assertion made by many yesterday — and in particular by Toobin — that Roe v. Wade will be overturned. After a few misfires, they play the clip of Donald Trump saying that judges he appoints will be “pro-life.”

Toobin responds to the clip by saying “Why does Fox News make fun of me? I’m just repeating what he’s saying.”

Toobin is apparently referring to a segment on the Ingraham Angle on Fox about “fear-mongering” over Trump’s pick. Host Laura Ingraham said the democrats have “already turned up the volume so hot on this” and that they were going to “gin up the base” by saying things like abortion will be illegal.

Ingraham played a clip of Toobin speaking on CNN yesterday. Here is what he said:

“Let’s talk facts. Let’s talk about what America’s going to be like that’s different,” he said in the clip. “You are going to see 20 states pass laws banning abortion outright. Row V. Wade is doomed. It’s gone, because Donald Trump won the election.”

Not exactly just “repeating what [Trump] is saying].”

In the CNN segment, after asking why Fox News was making fun of him, Toobin adds “there will be five of them, they will be pro-life.”

Host John Berman then says to Toobin that states will pass laws now knowing that Kennedy is gone. “Won’t they?” he asks.

“Of course. And they will do it this summer,” Toobin warns.

Netflix Reportedly Under Investigation For Streaming Child Pornography

A disturbing clip from an Argentinian movie that purports to show two young girls engaged in sexual activity has caught the attention of PJ Media, which reported it to the FBI and Department of Justice, along with the National Center for Missing and Exploited Children. In response to the tip, the DOJ has reportedly launched an investigation.

The scene is from a movie titled "Desearas" - or "Desire," in English. In it, two young girls who look to be about seven and nine are playing with two pillows when the older girl begins to masturbate, as the younger one watches. The scene includes a disturbing closeup of the child's face in slow motion. The film was directed by Diego Kaplan.

PJ Media advises anybody thinking about sharing the clip to abstain: Sharing child pornography - even if you're trying to "raise awareness" or get help for the victims - is considered distribution and could carry heavy legal penalties.

Child pornography is clearly defined by the Department of Justice in Section 2256, Title 18 of the US Code:

Section 2256 of Title 18, United States Code, defines child pornography as any visual depiction of sexually explicit conduct involving a minor (someone under 18 years of age).  Visual depictions include photographs, videos, digital or computer generated images indistinguishable from an actual minor, and images created, adapted, or modified, but appear to depict an identifiable, actual minor.  Undeveloped film, undeveloped videotape, and electronically stored data that can be converted into a visual image of child pornography are also deemed illegal visual depictions under federal law.

Notably, the legal definition of sexually explicit conduct does not require that an image depict a child engaging in sexual activity.  A picture of a naked child may constitute illegal child pornography if it is sufficiently sexually suggestive.  Additionally, the age of consent for sexual activity in a given state is irrelevant; any depiction of a minor under 18 years of age engaging in sexually explicit conduct is illegal.

And one promising company in that emerging industry is Nuro, a startup founded by two early members of the Google self-driving car team.

Now Nuro is announcing its first commercial partnership: with Kroger, one of the nation's leading grocery chains. Starting this fall, Kroger plans to start delivering groceries to customers using Nuro's autonomous vehicles.

Initially, the partnership will only be active in a single market—the companies haven't yet said which city that will be. But Nuro's goal is to eventually provide service across Kroger's entire retail footprint.

Musk Says Goldman "In For A Rude Awakening" After Bearish Report

Overnight, Goldman analyst David Tamberrino - who has a Sell rating on Tesla and a $195 price target - published a note that will guarantee he won't be invited to the Tesla holiday tent party, in which he wrote that he believes "the company is tracking below its 2018 Model S/X guidance of approx. 100k units" and that "Model 3 deliveries are tracking below consensus" adding that consensus expectations for the 2Q18 production rate appear elevated.

On the sensitive issue of Model 3 deliveries, the Goldman analyst said that he expects 22,000 deliveries, "below the consensus expectations of 28,000."

We believe that investors are continuing to track Model 3 VIN registrations (i.e., sequential vehicle identification numbers) as a proxy for the company’s production rate. Based on the ratio of registered VINs to the company’s 3Q17, 4Q17, and 1Q18 Model 3 production cadence, we believe that Model 3 VINs (highest VIN was 54,003 as of June 21) imply QTD 2Q18 production was at approx. 22,000 at the end of last week. Further, this is in-line with Business Insider which reported that YTD 2018 Model 3 production only totaled 30,000 vehicles (as of 6/19), implying 2Q18 production of approx. 20,000. Assuming the last few weeks in June ramp somewhat from the over 3,000/week production rate, we see total 2Q18 Model 3 production of approx. 28,000 vehicles.

As for deliveries, current data points suggest approx. 10,425 Model 3 vehicles were delivered in April and May (to US and Canada customers). As such, we increase our Model 3 delivery estimate to 22,000 (from 19,000 previously), although we remain below the consensus expectations of 28,000.

He also had some harsh words about Musk's strategy to extrapolate the quarter-end production burst (inside a tent) into the future:

Lastly, investor conversations on the stock have moved past the 5,000/week run-rate production target (as we believe most investors are giving the company credit for achieving this level entering 3Q18) toward vehicle profit margins and conversion of Model 3 reservations to higher priced vehicles.

And while most normal CEOs would skim the sellside research note and then promptly forget about it, instead focusing on proving the author wrong (by "sleeping on the factory floor" as the case may be), Elon Musk is no normal CEO and as Bloomberg reports, on Wednesday Elon Musk sent a companywide email to Tesla employees responding to the Goldman report.

They are in for a rude awakening :)” Musk wrote in the email in which he linked to a CNBC story that discussed on the Goldman report.

As is widely known, Tesla is in a race against time with just days left in the quarter, and is under enormous pressure to prove to investors that it can achieve and sustain higher levels of production. To hit his target, several weeks ago Musk erected a massive tent the size of two football fields which houses another Model 3 assembly line in hopes of topping off the missing units. Musk told investors during Tesla’s June 5 annual shareholder meeting that the company was “quite likely” to achieve its target to build 5,000 of the sedans a week by the end of this month.

The company will release second quarter production and delivery figures in early July, with an earnings call to follow not long after: while it remains to be seen what kind of awakening Goldman is in for, we can be certain that the Goldman analyst will not be allowed to ask any questions on the call.
